PORTLAND, Ore. (AP) An Oregon sheriff has sent a letter to Vice President Joe Biden saying his department will not enforce any new gun laws it considers unconstitutional.
Linn County Sheriff Tim Mueller, in his letter dated Monday, said politicians are "attempting to exploit the deaths of innocent victims" by supporting laws that would harm law-abiding Americans. The sheriff said he took an oath to support the Constitution, and laws preventing citizens from owning certain semi-automatic firearms and ammunition magazines would violate their rights.
"We are Americans," Mueller wrote. "We must not allow, nor shall we tolerate, the actions of criminals, no matter how heinous the crimes, to prompt politicians to enact laws that will infringe upon the liberties of responsible citizens who have broken no laws."
Mueller told The Associated Press in a phone interview from Albany, Ore., that he felt compelled to make his views known because sheriffs have not had much of a say on the vice president's anti-gun violence task force. Mueller said his constituents have been repeatedly asking his deputies about what will happen if new gun restrictions are adopted.
"We're restricted and prohibited from enforcing all types of federal laws, including immigration laws," he said Tuesday. "It would be unreasonable for anyone to think that I would enforce a federal firearms law."
The sheriff figures Biden probably won't even receive his letter, but "it needed to be said, so I said it."

The point he makes about how the Feds pick and choose which laws they want to enforce is very, very important.
The Feds have made it so that the Rule of Law is meaningless, therefore the laws they make to restrict our rights should also be considered meaningless.
What are they going to do - arrest this Sheriff? That’s actually what I want.
Rosa Parks was a secretary for the NAACP and she rode 4 previous buses before she was able to find one where someone rose a stink. It was all done intentionally to raise awareness to the issue. I want our Rosa.
Is there anything that REQUIRES state and local law enforcement to enforce federal laws to begin with? I know there are many liberal so called "sanctuary cities" that constantly brag that they forbid their local law enforcement from enforcing federal immigration law or working with federal agents on immigration.
Whoa, brother, you’re genius.
I want some mayors to start declaring “Sanctuary City” status for firearms owners against Federal laws.
I would find it hilarious to see Libs go after them.
To force a sheriff to enforce a law would probably require a specific court order.
You ask a good question. Recently the new mayor of San Diego ordered the police department to not enforce federal marijuana laws. The San Diego Police Department is complying with the mayor’s order.
Nothing I am aware of, however most federal crimes have corresponding state statutes, ie. drug possession, murder etc.

Very good news - I live in Linn County, he’s my sheriff!
And under the Constitution as intended there is no reason for their to be any such duplication.Murder and all but treason and counterfeiting of the currency should rightfully be state crimes.
The statists have been trying ,and succeeeding,in reducing the states to mere subdistricts of the central apparatus from the day the Signer’s ink dried.
Fantastic sheriff, I would like someone like that in my county. To all you other sheriff’s out there this is why we elect and empower you. Not to be Washington’s puppet, but to uphold and protect our rights.
This is why we not Washington decide whether you get reelected and pay your paycheck. The same thing goes for all police officers, you don’t work for Washington, you work for the people of your county or state. They don’t pay your paycheck we do!
The supremacy clause of the Federal Constitution has justly no more meaning to us than the rest of the Federal Constitution has to the Federal government. If they want to follow the Federal Constitution so will we, but their acts & edicts are by no means supreme when they are clearly beyond its enumerated powers.
Having taken an oath to uphold those limits in the Constitution it is your inherit job to ignore and resist that which goes beyond them.
