“"A right unexercised is a right lost!" Motto of OpenCarry.org OpenCarry.org was founded by Virginians John Pierce and Mike Stollenwerk in 2004. It's primary goal is encouraging the right to openly carry holstered handguns. It is the social networking headquarters of the open carry movement. They are working hard to end the intentional hoplophobic (fear of weapons) discrimination perpetrated against law abiding gun owners. These grassroots activist planted the seeds in 2004 and activism has sprouted across the nation. Alabama Open Carry (AOC) is leading the charge to "Dare Defend Our Rights". AOC is a grassroots effort to educate Alabama citizens that: 1.The Alabama State Code contains no law making open carry of a handgun illegal. 2.The Alabama Supreme Court has declared that the Alabama State Legislature cannot make laws restricting open carry since our State Constitution (Article I, Sec 26) recognizes the right to bear arms. 3.Open carry of a firearm by law abiding Alabamians doesn't fit the criteria for disorderly conduct (13A-11-7) in any way, shape, form, or fashion. The use of this statute against law abiding citizens constitutes blatant discrimination. 4.13A-11-55 defines 13A-11-52 as the only illegal carry of a pistol on "premises not your own" as concealed carry without a permit. 5.It is illegal for any municipality or county to make open carry illegal. This power belongs to the State Legislature solely. Alabamians who become aware of city or county governments circumventing this law should make waves. The squeaky wheel gets the grease. I was out shooting my Heritage Rough Rider .22 in my back yard Friday when I heard the mail man stop at my box. I walked down to the road (about 100 yards) to get my mail with my .22 still attached to my hip. As I started back up the drive an Alabama state trooper stoped me. He asked me for, and I showed him my ccw permit. He informed me that it did not permit me to open carry and if he wanted to he could confiscate it. He let me keep it and we parted ways. He was polite and so was I. This prompted me to do a little research where I found this article.

I don’t understand. Why would you need a concealed carry permit to open carry?

And he “let you keep” your pistol? What a guy....

Indeed, if it is completely legal to open carry, especially when you are on your own property, you should call the Alabama State Trooper Headquarters and report that ill-informed trooper, and you should tell them that you are going to forward your account to OpenCarry.org for potential legal action against them.

At the time neither one of us knew “the law”. I will be better prepared next time.

Yea, well don’t get me started on alabama state troopers. Even the Co. cops and city think they are assholes.

But it is your responsibility to know the law and your rights. I read here or somewhere that if you are arrested for something that is not against the law, then you have no recourse. The Supreme Court says that it is your responsibility to know your rights not the cops. I know this to be true. I read it on the internet.....
