Judge rejects prosecution motion to bar public from Reese hearing

A court order filed yesterday and obtained by Gun Rights Examiner in the case of U.S. vs. Reese has denied a motion by the prosecution to seal a hearing from the public. Defendants Rick and Terri Reese and son Ryin, New Mexico gun dealers jailed for allegedly knowingly selling guns to cartel members, and who have since had conspiracy and money laundering charges against them dismissed, have filed a motion for a new trial after being convicted of, as Jeff Knox of the Firearms Coalition described it, “the comparatively minor charge of lying on gun sales forms -- even though the lies they were convicted of were perpetrated by federal agents and the Reese's crimes were that they ‘should have known’ that the agents were lying.”

“To justify the closure of a courtroom over the objections of a defendant, ‘the party seeking to close [a public] hearing must advance an overriding interest that is likely to be prejudiced, the closure must be no broader than necessary to protect that interest, the trial court must consider reasonable alternatives to closing the proceeding, and it must make findings adequate to support the closure,’” Judge Robert C. Brack of the United States District Court for the District of New Mexico wrote in Friday’s order.

“The Government has not met its burden in light of the Government’s disclosure of the witness’s identity in open court,” Brack continued. “Further, the Court has been told for at least two years that the Government could not seal a hearing and could not agree to seal a hearing as a result of a policy adopted by the Attorney General.

“The position of the Government here runs contrary to this policy without an explanation,” the judge determined. “The Court is all the more disinclined to seal the hearing

Yes The governmen has acted abominable in this case.

It is absolutely disgusting what they have done to this family.

Tactics like these are what is coming to those who refuse to knucle under to Feinsteins gun bill.

Absolutely shameful from the git go.

It would be very convenient for Eric Holder if the entire family were to simply "disappear."

That's the way all banana republics handle this sort of problem.

Now this is the money quote, I find it unfathomable that the Judge did not Dismiss the entire case and charge the prosecutor and the feral agents. It’s not too late Judge.

But on the other hand , I want to see and hear testimony in the court case that will implicate the Fed administrators who directed their agents to coerce and intimidate the dealers into submission.
This court hearing could be used for discovery for a further civil suit action against the Fed as well as libel and slander civil suits against the media.
The fed’s attempt to paint this family enterprize as gunrunners , part of “Fast and Furious”, could bite them in the a$$ .
The Fed already got their publicity, now it’s time for pab-back !
Which actually begs a bigger question :”Can you sue the Fed under RICO laws “ ??

Rick and Ryin Reese, and wife and mother Terri, former proprietors of New Deal Shooting Sports in Deming, along with son Remington, had all charges against them for money laundering dismissed, and were then acquitted of knowingly abetting gun trafficking in early August of this year. The family has had assets needed to mount an effective defense seized, and Rick and Ryin have been jailed since their arrest in August of 2011. Wife Terri made bail in late March when she was released to a halfway house.

The remaining outstanding convictions awaiting sentencing, two against Ryin and one each against Rick and Terri, are, per Jeff Knox of the Firearms Coalition, “the comparatively minor charge of lying on gun sales forms — even though the lies they were convicted of were perpetrated by federal agents and the Reese’s crimes were that they ‘should have known’ that the agents were lying.”

In spite of this, and in spite of growing evidence that the family has been subjected to a chronic and habitual liar of a snitch trying to save his own skin and demonstrably false testimony from government agents,

The Reese’s live in Deming, NM, halfway between the Arizona border and Las Cruces, NM. It’s not a large place, has an excellent cafe at a truck stop, and its population probably is less than 10,000 (I’m guessing)>

The ATF used 4 FOUR Armored Personnel Carriers, many, many federal agents, and were armed with automatic weapons in the arrest of this family at their place of business.

The raid was a massive overreation by the federal government and I’m so happy that the Reese’s are seeking a new trial on the one guilty charge the jury found.

The government in a massive waste of our taxpayer dollars was unable to convince the jury of the Reese’s guilt on thirty other charges.

BTW, here in Las Cruces, NM, the federal government in another massive waste of taxpayers’ funds, just completed building a new federal building. It faces the southwest and has 3 story high glassed entry. For those of you unfamiliar with LC weather, today it’s 65 degrees, and gets to be 115 or so in June. It can hit 100 in April.

The hottest time is in the afternoon or early evening, when the sun is in the (YOU guessed it!) the southwest!!
