A mother and daughter who were mistakenly shot by Los Angeles police hunting for rampage suspect Christopher Dorner had no warning before bullets started whizzing through their newspaper-delivery truck, their lawyer said Friday.
No command, no instruction, no warning. They just opened fire on them, said Glen Jonas, who is representing Emma Hernandez, 71, and Margie Carranza, 47, in possible legal action against the LAPD.
They had no idea what was going on. Theyre huddling, covering up and praying and hoping theyre not going to die.
Both women survived. Hernandez, shot in the back, was in good condition Friday. Her daughter suffered a hand injury during the shooting and is now physically fine, but emotionally scarred, Jonas said.
The LAPD admits the predawn Thursday shooting was a case of mistaken identity that unfolded while police were guarding the Torrance home of someone named in a manifesto that ex-cop Dorner posted online about his twisted plans to avenge his firing.
Chief Charlie Beck said the officers saw a vehicle that matched the description of Dorners, driving through the dark streets with no headlights and a police-involved shooting ensued.
Jonas said the womens blue Toyota Tacoma looked nothing like Dorners dark-gray Nissan Titan, but that even if it had been a match, the police should not have fired on it.
They still have to give the guy an opportunity to surrender. You cant just execute him, the lawyer said. Its in these high-stress situations where you follow your training and they violated every piece of training they ever received.
The LAPD had no comment on Jonas claims.
He said he expects the city will offer his clients a substantial payout; if not, he plans to file a federal civil rights lawsuit.
Thank God they didnt die. Its a miracle they didnt, he said. If it was a movie, you wouldnt believe it.
Aggravated Assault, Attempted Murder, violation of Civil Rights under color of authority (The Rodney King Federal Charge). I could probably think of a couple more.
I only wish I could be their attorney on a retainer for the Civil suit. These ladies will be rich someday soon. Their attorney will get 1/3. Heck, I'd do it for 1/6.

These guys are fired. There won't be any jokes around the water cooler for these idiots. They failed to identify their target before they started shooting.
The vehicle that they shot at didn't even match the description of the vehicle that was the subject of the manhunt. There is no comparison between the little old ladies truck and the one they found burned in Big Bear.
If either of these ladies had been mortally wounded these guys would be going to prison.
They will probably avoid prison but they will be charged and convicted of some kind of felony. They will never be given the chance to kill someone with a firearm again.
I count at least 30 rounds all over the back end of that truck.
A.) The women are lucky to be alive, and B.) those idiot cops should be fired and barred from ever carrying a gun again.

I used to deliver papers in the early AM, and driving (idling along, actually) the side streets with the lights off while the runner goes house to house is quite normal: It’s a courtesy to the residents, so your lights don’t disturb them.

Funny, no boot lickers on this thread berating these women like they did for a former Marine named Jose Guerena defending his home against unkown attackers (cops).

In the real world (which bears little resemblence to the movies), most people survive a gunshot wound.

So police should be limited to seven rounds in their magazines. That will fix it. Oh! Maybe they shouldn’t have semi-auto weapons. There wouldn’t be so many bullet holes in Toyotas.
I would suspect that paper deliveries and everything else that requires night or early morning driving with a truck is going to be severely restricted.
