Nathan Bibeau of Lewiston, Maine said he made an unsettling discovery during his son Caydens 2nd birthday celebration. After the toddler blew out the candles, his Elmo-themed cake was cut and four pieces in, he found a paring knife inside the dessert. So the party was paused and Bibeau called the Auburn Walmart bakery where he purchased the cake to inform them

While the father says he understands that mistakes can happen and will still shop at Walmart, he has contacted a lawyer and is considering legal action.

Look in this fellows knife drawer and see if there are any in there to match it.
Walmarts attorneys will rip him a new hole and allege that he planted it so he could file the lawsuit. They will disintegrate him and ruin his reputation. He has no idea what he’s getting himself into if he sues them. He’ll be lucky if he gets $500 in a settlement agreement and he’ll still owe his attorney $20 -50K...lol. I say go for it liberal idiot.

That’s an entirely different situation. There you’ve got prima facia evidence of damages and witnesses in an environment where theyt can attest to what they saw. The injury occurred on property owned by Walmart and under their control where they control the safety parameters. In addition the victim suffered real life threatening injuries as a result of their negligence and he incurred expenses for medical care. In this situation there’s no damages; Walmart would make him a new cake, apologize and throw in sone more goodies for measure and he knows it. This is a situation where a young liberal sees an opportunity to cash in. Sometimes people make mistakes. This was one of them and the liberal doesn’t want to be forgiving because he sees an opportunity he can exploit or profit. Trust me, Walmart’s attorneys have already been contacted and they are running a background check on him to see if he has any prior convictions or filed any frivolous lawsuits in the past among other things.

I live in Maine and I saw this story on the local news a few days ago.
They showed the knife; it was much larger than a paring knife, but it was lying flat underneath the cake and didn’t seem to present a danger to anyone.
As I watched, I thought, “Why is this guy running to the news media?”
The reporter said that Walmart contacted the guy and asked how they could make things right.
When I heard he was contacting a lawyer, I figured he’s just another loser who is trying to win the lawsuit lottery.
“Im hard pressed to think of a purpose for a paring knife in the bakery.”
I agree, I think he chose the wrong knife for this scam...expect it to fall apart soon.
Common sense dad would have said, “Cool, free knife!”
Fifty years ago common sense dad would say, “Great, now i have to return this knife.”
Dang! That cake was supposed to be delivered to the penitentiary in Lewiston!

It was a simple mistake. The cake was intended for the local jail.

On numerous occasions over the years I've been under charged at Wal-Mart because of a case of Diet Coke under the cart and I always tell the checker it is there. I cut out the U.P.C. and the next trip to W-M, I take it with me, go to the service desk and pay for it.
The part I don't like about it is if they make a big issue of my "honesty", when anything less than that is stealing.
To be sure, if I am over charged, I let them know about that too but that rarely happens.
Now that the TSA in its wisdom has made a big fanfare of announcing that knives are now allowed on flights, the cake with its contents can pass through the x-ray machines at the airport with nary a second glance.
Reminds me of the Little Rascals prize cake.
Hoffa will send him a team of lawyers to help him sue Walmart.
Good thing that cake was not delivered to a school. There would have been a swat team show up.
