The unloading of the mental institutions and putting the insane on the streets by the ACLU in the 1970’s is what has caused the crisis. The insane should be behind bars where they have no access to any guns.

the shooter in Connecticut was not in the mental health system. i understand that his mother was trying to do more for him but was unsuccessful. The Colorado shooting at Columbine not in the system thus mental health check would not helped. The Movie theater shooter was about to be in the system, but mental health services were discontinued when he was kicked out of the university.

You want backgrounds at a level. Okay lets say your parent has Alzheimers disease - you will have to give up your guns if your parent would be in your home for 2 weeks.

Or won't fully disclose symptoms if they do. If you don't feel free to discuss all your symptoms, you won't get the best care. If your clinician suspects you're holding back, this will affect his assessment of your risk and his liability.

Yeah Saying a former felon can’t own a gun is just as foolish as declaring that any other free person can’t own a gun. If a felon wants to get a gun, he will.

The guy who ambushed firemen on Christmas did time in prison for beating his own grandmother to death with a hammer. He was out of prison and got a gun he wasn’t supposed to have. If he had been kept in prison or executed, the shooting wouldn’t have happened.

Just last month the 19 year old son of one of my old schoolmates stabbed his mother to death just weeks after the court had denied an involuntary hospitalization attempt by the parents.

Keeping the mentally ill from possessing any gun is a theoretical good idea. The problem will always be in the details.

In addition, unless the HIPAA law (patient confidentiality) is changed, the data base can not ever be created.

Obamacare has so many data sharing points that IMHO it definitely WOULD be possible. Besides, Sebellius can issue regulations at will. Whether the database would be secure, accurate, and protective of privacy is another matter. Obamacare destroyed the ability of patients to control the flow of their health information.

Graham is dangerous. Anyone deemed “depressed” or PTSD or OCD or anything else can be prohibited from owning a firearm.

Every adult should be allowed to own firearms without a special license or passing of a criminal backrgound check including the nutbars. How many nutbars are not allowed to drive cars because they are crazy? Why should a nutbar be denied the right to self-defense with a firearm or any other weapon?

Liberalize Constitutional Carry for every State.

If a nutbar (or anyone else) mis-uses a firearm everyone else will simply turn around and kill that murderous soul.

This is probably the one thing I agree Graham on. A while back the ACLU successfully argued the closing of alot of mental health facilities.... so in reality we probably have alot of folks out there who should be looked after.

And actually if you want to argue ObamaCare that would be the only argument you would make is for the mentally ill.

Maybe we should look at the mental health of anyone who wants to punish all for the behavior of the ACLU.

I’ll be honest with you, I think some form of restriction on allowing people with serious mental problems to buy guns is perfectly reasonable, as long as it is done right.

Who gets to define what a "serious mental problem" is?

The problem is that the government will make the determination and basically anyone who ever told their doctor that they were depressed or suffering from anxiety or has received a prescription for Paxil or Prosac or valium could be barred from ever owning a firearm.

Don't get suckered into this. Americans have a RIGHT TO BEAR ARMS. It is not conditional. It is not subject to government approval or subject to being examined by a mental health official.

If you commit a serious crime, then your rights can be stripped from you as a punishment for the crime. But other than that, everyone in America has a RIGHT TO BEAR ARMS.

Exactly. Look at who can be included in the database. Some will be included AFTER adjudication and some WITHOUT any adjudication whatsoever.

And there will be no consistent application of standards for those not adjudicated. Some will get evaluated by physicians. Others by psychologists. Some by masters level clinicians. Some by student interns. Others by cops and medics. There will be different levels of expertise and different evaluations for those put in the database without legal adjudication.

I just don't believe in stripping people of their constitutionally given rights without adjudication.

I don't want crazy people with guns either...........BUT!

The problem is all the liberals and left wing psychologist out there will use this power to disarm everyone.

What's the saying, "every therapist has a therapist".

They believe everyone is crazy and they will compete to see who can disarm the most people.

I'll take my chances in a armed society any day over one disarmed by pointy headed intellectuals.

Because when the rest of the world comes calling and they will, they will be armed.
