PHOENIX—An Arizona judge on Friday refused to grant a divorce for a transgender Arizona man who gave birth to three children after beginning to change his sex from female. Maricopa County Family Court Judge Douglas Gerlach ruled that Arizona's ban on same-sex marriages prevents Thomas Beatie's nine-year union from being recognized as valid. Thomas Beatie was born a woman and underwent a double-mastectomy but retained female reproductive organs and gave birth to three children. Gerlach said he had no jurisdiction to approve a divorce because there's insufficient evidence that Beatie was a man when he married Nancy Beatie in Hawaii.

A double mastectomy does not turn a woman into a man or there are a lot of breast cancer patients out there who have become men.
Male hormones don’t turn a woman into a man even if too much of them will put whiskers on her - they won’t make a penis and testicles appear.
Two working ovaries, a uterus, a vagina, no Y chromosome and three successful pregnancies would pretty much seem to prove someone is a woman but what do I know?
I don’t live in a crazy person’s head and I don’t write crazy legislation and I don’t write crazy propaganda news stories, so I don’t know anything.
IMO, the judge ought to grant her a divorce from reality on grounds of abandonment and failure to support.

"Thomas" is on the left. Those are three kids he carried to term. There was talk of a fourth but I don't know if it happened.
Now that his divorce has been denied, the LGBT lawyers will gin up a lawsuit to force AZ to recognize his marriage and grant the divorce and force them to recognize transgendered and/or same sex marriage.
That is the whole point of this or they would have gotten a divorce in HI.
Someone should ask Annette Bening about this. She must be an authority as she starred in ‘The Kids are Allright’; a movie about two lesbians raising a boy and a girl. And she and Warren Beatty have a ‘transgendered’ daughter/son.
That was the Judge's point. As a practical matter, I'm sure the Dad/Mom here wants to spearate her "wife" from a significant share of her income until the kids are 19 (Mommies get an extra year in the Daddies pockets in AZ).
