A state appeals court today threw out a $7.7 million verdict in favor of a Jersey City doctor who slipped and broke her elbow at a PATH station in 2007.
The court said the Port Authority of New York and New Jersey, which operates the PATH trains and their stations, can’t be held liable unless passengers are injured while riding, boarding or leaving a train.

The corridors at Newport station were notorious for having stalagtite like formations from leaks coming from above. In a few places there were pools of water that seemed to have partially mineralized the tile they’d been there so long. Very easy to slip if you were unawares.
Agnostic about this ruling but they really should clean that place up.
Well the judge should have ordered the locals to clean the place up and cover the person’s medical bills and time off from work. But $7M?
The amount of judgement was probably based on her age and projected lifetime earnings.
Newport was one of the dirtiest path stations.
I wonder if the “jury” thought she was a renowned kazoo player.
It sounds to me like a major point in this case — either by the plaintiff or the defendant — revolved around the legal exposure (or a limit of liability) of the PATH system as a railroad under Federal law.
The ramp at Newport to the escalators down to the stairs for the tracks is dangerous and has been for years. Walking on those tiles with wet shoes is an invitation to break an arm. It may not be worth $7 million but they really should replace the floor tiles.
See, I’m not the only one who thinks the Newport station was an accident waiting to happen. I made the mistake of wearing dress shoes through there once for an interview. Just about killed myself. Fortunately I had an umbrella and caught myself with that. Most of the time I wore combat boots to work. Those were 3.5 season shoes in NYC and fit the bill.

same should hold for govt locations
