There is currently a case working its way through the courts on a off duty Seattle cop who did something similar. He had noticed a drunk driver and followed them until they stopped and then held them at gun point until on duty cops showed up.
The gist of the case was unlawful display of his firearm. SPD has lost the case in district court, court of appeal, and is planning on taking it to the Supreme Court. The court at each venue has sided with the victim who sued for being unlawfully detained. Although the court has upheld his case they only awarded him $1 but legal fees to fight for the right to draw down at anytime have exceeded $600,000!
