HELENA, Mont. (AP) -- Montana Gov. Steve Bullock will sign into law a bill that decriminalizes gay sex, 16 years after the state supreme court ruled the law unconstitutional.

The bill's passage received an emotional response from gay-rights activists, who have struggled for 20 years to remove the obsolete law.

I thought anti-sodomy laws were already ruled unconstitutional by the Supreme Court back in 2003?

Sodomites want the stigma removed and the laws stricken from the books. Something they were unable to accomplish through the legislatures which is why they went the activist judge route.

that’s what I thought too... and yet ... I saw an article here posted the other day about a teacher that had oral sex with a young male student being charged for “sodomy” and could face up to LIFE in prison for it!

As much as I believe that gay sex is sinful and as much as I am repelled by it, I don’t think that a law punishing sodomy is in the best interest of a free society.

Having said that, I believe likewise, that laws FORCING or COERCING devout, religious people to celebrate, accept and subsidize such acts are evil.

Well this is the utmost importance after all, 3% of our country care about it and it’s not like we’re drowning in taxes and regulation and can’t afford to feed our family and drive to work.
Sure, anal sex should be top priority everywhere. This is why I work and get half my income taken; to pay the salary of some dopey lawyer politician who obsesses on making sure anal sex is promoted and legal.

The article doesn't mention the Governor's party affiliation, so I googled it and he's a RAT. How the heck does Montana keep ending up with RAT Governors and RAT Senators? He's probably a liberal RAT too. If the Dems had the kind of defeatist "leadership" we have our side, they'd be lecturing their members that Montana is a "Romney state" and a pro-life, anti-gay rights, Bush loving Democrat is "the best we're gonna get in a state like this"

Exhibit #4,653,765 why the Dems are in power and we're not

Well said and I agree. Not every sin is a crime. If two consenting gay adults want to have sex, we may not agree with it but that does not mean they should be locked up for it. I also agree that the government should not advocate on behalf of gay people or subsidize them with tax dollars.

Agree.

Agree as well, certain behavior, however legal, should ALWAYS have a social stigma attached to it and should always be kept “at the margins” of the civil society.

You are commenting without having read the article (which is of course a cottage industry here at FR - myself included).

3rd paragraph:

“The bill received the Senate’s endorsement earlier in the session with little fanfare, but was stuck in a GOP-controlled House committee until Democrat Bryce Bennett of Missoula led the effort to put the measure to a vote in the House.”

This is a SYMBOLIC gesture. The act itself is no longer prosecuted.

YES for the Governor to sign it, it must be in a bill.

BUT it is meaningless in "changing law" now.

YOU should do more reading, perhaps.http://billingsgazette.com/news/state-and-regional/montana/montana-house-endorses-measure-to-decriminalize-gay-sex/article_79b4d3e9-c54a-5cc5-86cd-695dcf6d5750.html

“It’s not about encouraging a lifestyle,” said Rep. Bryce Bennett, D-Missoula, one of the Legislature’s only openly gay members. “It’s simply about respecting privacy between two adults. … It’s just as simple as saying that all Montanans deserve dignity and respect.”

...Passage of SB107 would culminate more than 20 years of attempts by gay and lesbian activists and their supporters to repeal the law, which lumps gay sex in with “sexual intercourse with an animal” as criminal deviate sexual conduct...

A 1997 decision by the Montana Supreme Court declared the law unconstitutional and Montana prosecutors have not enforced it – but repeated attempts to repeal the law, until Tuesday, have been blocked primarily by Republicans in the Legislature....

...But other GOP members spoke in favor, including Rep. Duane Ankney, R-Colstrip, who said the law labeled his own daughter a criminal. “To say she is any less of a person or a criminal for her lifestyle … really upsets me,” he said. “I consider myself a good Christian … and I don’t think God thinks any less of my daughter than he does of any one of you in here. The law is an embarrassment on the people of Montana. It should go away.”

Activists have been pushing for repeal even since the state supreme court invalidated it (far earlier than the USSC). IF they felt the PUBLIC was supportive of the measure, they should've have changed the law in the legislature, not the courts.

I thought anti-sodomy laws were already ruled unconstitutional by the Supreme Court back in 2003?

The laws still remained on several states' books after the Court decision, which only prevented them from being enforced. Texas, Oklahoma and Kansas still have their anti-sodomy laws officially in their penal codes.

This is not good for Montana, because the sodomite lobby, as always, deem permission as promotion (which is exactly what they did with Lawrence v. Texas), and are likely to now launch a massive campaign to push their perverted agenda in schools and workplaces with the State's enforcement powers.

They've been fighting to have Kansas' anti-homosexual sodomy law stricken, but have not succeeded - yet. I pray that they never do. It remains as a public sanction against their perversion.
