No Miranda rights for now for bombing suspect

The Boston Marathon bombing suspect captured Friday night will not be immediately read his Miranda rights, a Justice Department official said.

The announcement came as a debate broke out among lawmakers, lawyers and political activists over whether the suspect, Dzhokar Tsarnaev, should be prosecuted in a civilian criminal court or subjected to military interrogation and over when and whether Tsarnaev should be told about his right to an attorney.

Well, that pretty much does it. If any of the authorities asked him any questions, he walks free because there is no way in hell he will be tried by the military. Way to go, Holder!

I saw several reports he was just mirandized. They didn’t do it initially but was he conscious or coherent when they first arrested him? I think the reports were just jumping the gun.

And if he choses not to talk? - how are we going to get all that valuable information about how this came about and who else is in it with him that all the talking heads are slobbering over? - will we finally decide that maybe torture can be used after all? - should be interesting........

From what I understand the Government can’t send an American citizen to gitmo and this piece of excrement is an American citizen albeit by naturalization. Unless the government revokes his citizenship he can’t be interned at gitmo and his citizenship can’t be revoked until he is convicted. Catch 22

He, as much as we despise it, is an American Citizen that committed terrorism on American soil.

How long until they label freepers as terrorists and take away our rights as well?

Sorry, but I don’t agree with the majority here on this. Obama has grabbed too much power for the FEDS as it is to suit me.

Almost all military and naval bases have a golf course of some kind, even tiny Camp Red Cloud in Korea where I was stationed in the 70's. Guantanamo has a nine hole course, as you can see above.

He's a US citizen--so he should already know about his right not to say anything.

How many people were put to death for their complicity in 9/11? or in the World Trade Center bombing of 1993? or in the attack on Waco in 1993? (oops--scratch that--that would be Holder, Reno, Bill and Hillary).

10 years from now Tsarnaev will be either still waiting for his case to be heard, or filing appeals from the verdict.

Two things have to be present for Miranda to be applicable. Hollywood never gets this right. First is a custodial situation, under arrest or not free to leave. Second is interrogation. If both do NOT apply, then no Miranda is needed. If they arrest him and have no plans to talk to him, no Miranda. Or if as reported, he really is in no condition to chat, no real need for Miranda yet. I bet this kid gets a printed out version for him to sign and likely a videotaping of the event just to make double sure.

US Attorney Carmen Ortiz stated exactly that at the press conference.
