Statement by ACLU Executive Director Anthony D. Romero on Miranda Rights of Boston Bombing Suspect Share

The American Civil Liberties Union reacted to the apprehension of the suspect in the Boston Marathon bombing and statements from federal officials that he would be questioned without being read his Miranda rights.

"The ACLU shares the public's relief that the suspect in the Boston Marathon bombings has been apprehended,” said Anthony D. Romero, ACLU executive director. “Every criminal defendant is entitled to be read Miranda rights. The public safety exception should be read narrowly. It applies only when there is a continued threat to public safety and is not an open-ended exception to the Miranda rule. Additionally, every criminal defendant has a right to be brought before a judge and to have access to counsel. We must not waver from our tried-and-true justice system, even in the most difficult of times. Denial of rights is un-American and will only make it harder to obtain fair convictions.

"Our thoughts remain with the victims of this tragedy and with the entire Boston community."

I will get clobbered but he had citizenship, so yes, I think he should be read his rights.

If they can do it to him, they can do it to the rest of us.

This guy received his U.S. Citizenship on 9-11-2012.

Don't you know he got a laugh out of that? A Muslim Terrorist receiving his American Citizenship on 9-11.

I would agree....US citizen that he was....I don’t think this was wise to skip the rights. It’d be different if he did all of this off US soil.

Whether he is entitled to them or not...READ THEM.

That way we just have all the bases covered. If they didn’t then law enforcement is directly to blame when all their evidence gets tossed out of court.

And just imagine if this guy had been on foreign soil, he could have been taken out with a drone, he could be in some hell-hole of torture right now being interrogated, all kinds of things could be happening to this ‘citizen!’ In fact doesn’t 0bama have an Executive Order that clearly states this ‘citizen’ can be detained indefinately and even shipped out of the country for his detention?

Gee...might be a darn good time to use it wouldn’t you say Mr. President?

Rights are rights, they are not granted by the government, but granted by simply breathing. You have a right to keep and bear arms, a right to the freedom of speech, and a right to refuse to answer questions.

And I think that this young terrorist should have the right to refuse to answer any and all questions, should be able to consult with an attorney, etc. And should he invoke those rights, I think that the FBI should announce his immediate release, invoking the time and place where they will discharge him from custody, preferably at a large park, right after an accidental spilled load of baseball bats litters the ground.

He can decide then if he wants to possibly waive some of those rights, least for the time being. I’m sure the mob will gather to cheer on his exercise of freedoms, and appropriately reward the man for his choices of the past week.
