Thirty-five years after the Supreme Court set the terms for boosting college admissions of African Americans and other minorities, the court may be about to issue a ruling that could restrict universities' use of race in deciding who is awarded places.
The case before the justices was brought by Abigail Fisher, a white suburban Houston student who asserted she was wrongly rejected by the University of Texas at Austin while minority students with similar grades and test scores were admitted.

Sandra Day O’Connor once said affirmative action (race based preferences) would be “constitutional” for about another twenty five years. People wonder why the Supreme Court is held is such low esteem?
This case will be rightfully tossed out on the merits.
Texas grants admission to anyone in the top 10% of their high school class. This is not a race based rule but this rule will often mean that a person (hispanic, black or white) may be admitted over someone else with superior test scores.
Furthermore, the only person who has standing to sue would be the next person in line. That person is probably not Fisher. That is if they dropped the 10% rule, some people are out and others are in but it probably not Fisher therefore Fisher has no standing to sue on behalf of others.
Sorry but this case is going nowhere and going nowhere for grounds.
She is not contesting the top 10% automatic admission rule. She is contesting the fact that if you are outside of the top 10% you can still be admitted, but only if you are the correct race. Admissions outside of the top 10% are determined almost entirely by racial quotas.
The automatic 10 percent is what ought to be challenged...

I still remember something from over a decade ago.
I made a point of teaching my oldest kid to read (phonics, of course), and then I taught him math (Saxon, of course). He did great, and by the time he was old enough for Kindergarten, he was able to divide fractions (try that if you’re bored).
Anyway, we went to a “parent day” at the top school in Houston (private, of course), and they told us the same thing: Only 10% of their kids will get admitted to a Texas flagship school...the other 90% will have to hope.
We said thanks, but putting our kids in the crappy Houston school district gave them a better chance, so we did.
I believe white males are already a minority on campus just about everywhere you go.... good enough reason to eliminate Affirmative Action policies immediately.

True and the person suing is a white girl who are the largest plurality in college now.
The rule being challenged does not mention race. True, the result is more minorities get in, but the rule has zero mention of race.
It only says the top 10% of a high school class get in.
True but the liberals who wrote the rule are only borrowing from the text book written by white racists from an earlier period.
For example, the old immigration quota system says that a country's quota was determined by how many current residents of that country are in the US. That meant Germany and UK got huge quotas and India and China got nearly zero.
