Outgoing IRS Chief: Taxes 'Voluntary'

On Friday, former acting IRS Commissioner Steve Miller, testifying before the House Ways and Means Committee, said that America’s tax system is “voluntary.”

Rep. Xavier Becerra (D-CA) agreed. Miller offered this perspective as he was grilled about his involvement in the IRS scandal wherein the IRS targeted conservative groups, particularly Tea Party organizations.

This line has been used before by none other than Senate Majority Leader Harry Reid. Interviewed by Jan Helfeld in 2008, this is how the conversation went:

Helfeld: If the government is in the business of forcefully taking money from some people in order to provide welfare benefits to others, how will the people whose money is being taken feel about the government?

Well, I’d love to volunteer “no,” but it’s actually legally mandated. Just try not paying your taxes and see how “voluntary” it is.

I remember when Dingy Harry Reid made this claim several years ago.

Do these idiot Democrats honestly think that paying taxes is voluntary? Is that how they justify their insatiable craving for taxpayer’s money?

Voluntary is how I give to my church, what I want to give, when I want to give it.

My taxes are withheld from my paycheck, taken when I make a purchase or figured into my mortgage.

I cannot choose not to pay income taxes.
I cannot make a purchase without paying sales tax.
I will lose my house if I don’t pay my property taxes.

In what universe is any tax voluntary?

They have us cornered. Animals that are cornered can become very violent.

The reason the income tax is voluntary is that it doesn't fit into the two great classifications of taxation -- direct and indirect. The Constitution allows for direct taxation, but the taxes must be apportioned. The 16th amendment did not amend the Constitution. In order to understand this, one must read Irwin Schiff's The Great Income Tax Hoax. In that book, political prisoner Irwin Schiff, points out that income for income tax purposes is really a corporate profit (and it is certainly not wages).

The easier argument is that the income tax violates the fifth. That argument points out that if the income tax were mandatory, one cannot use one's tax return against one in a tax evasion case since one would be using compelled testimony in order to convict oneself. On the other hand, the IRS and the mis named justice department illegally tries to throw people in jail for not filing. The government has been getting it both ways. As the so-called income tax (so-called since it is really voluntary) is enforced illegally, it is no wonder that the IRS breaks the law when threatening the Tea Party and the Jewish Z group.

Thanks to a corrupt judiciary, the IRS has been getting away with its illegal behavior for almost a century.

With all BS aside, if ever there was a time in our history for an outright tax rebellion it is now. Everyone that works should just stop until this corruption is dealt with and reform is made. Quarterly filers, quit filing. W2 types change their exemptions to 20. Stash away the money and starve this insatiable beast. IF just 1 million people did this, these communists would crap their pants and we would see some immediate changes. They need us...we don’t need them.
IF you think they targeted us with tax exemption, wait till they start targeting our health care!!! This is NOT acceptable.

An additional way to explain it in addition to the info posted here.....via our founding underpinnings we've chosen a certain type of government which is based on taxation and in agreeing to our type of government we voluntarily agree to pay taxes as did the settlers.

In that sense, taxes are "voluntary".

Confiscation of wealth through taxation is not voluntary, nor is taxation without representation voluntary because while we agreed to taxation we never agreed to tyranny.

I could go on, but you get the drift....the bloke was technically correct in calling American-type taxation "voluntary".

(I need an Exedrin).

These are fascinating links but of what practical value are these arguments? The politicians have emplaced a rogue government and are quite happy with how it functions. Debating the Constitution with them is a wasted exercise since they have no concern what the document actually says or means. They may even agree with you and then go about their business as usual with a “so what”.

I think the public at large would consider this a lot of legalistic mumbo-jumbo and continue to elect politicians based on perceptions of “what are they doing for me”. I think before we can argue on the merits of the Constitution, we must argue the merits of the underlying principles in plain English as best we can. Then we can connect the dots to the Constitution.
