Lawsuit Says 77-Year-Old Veteran Died After Police Tased Him

After wandering away from the Montana Veterans’ Home in Columbia Falls last June, a 77-year-old Korean War veteran suffering from severe Alzheimer’s disease was tased by police, fell face-first to the pavement where he struck his head and died later due to injuries from the fall, according to a lawsuit filed last month by a family member representing his estate.

Tamara Downen of Columbia Falls filed the lawsuit on April 5 in Helena’s Lewis and Clark County District Court, claiming that her grandfather, Stanley Downen, died as a result of negligence by the Montana Veterans’ Home, Columbia Falls Police Department and Montana Department of Public Health and Human Services.

The lawsuit states that on May 31, 2012, Stanley Downen was admitted as a resident to the veterans’ home, described as a “nursing facility that includes a 15-bed Alzheimer’s unit.” Downen had a “history of behavioral issues and advanced dementia resulting from severe progressive Alzheimer’s disease.”

I’d call that manslaughter. The man with the taser needs to do time.

If the cops are afraid of the level of injury a 77 year old man *might* possibly inflict upon them, they should find a nice, safe job, not one where they have to face the occasional danger.

Too late. The motto for police has changed from “To Protect And Serve” to “To Tase Until Compliant”.

“Its not the job of the police to accept getting hit or being subjected to the physical outbursts of a violent person”

Yes, it sure as phuck is. If someone is slinging fists they are supposed to respond accordingly, not murder 77-year-old men.

That’s just one more reason that women should never be allowed to play-pretend at police officer.

Alzheimer's patients can get pretty violent. Don't know if this guy was or not, but there's a lot of other things we don't know as well.

He was 77 years old!!! How much of a physical threat could he pose to couple of cops?

PS....I spent several years as a primary caregiver

Never call the police.

I agree with you. Get the right tools and learn to take care of you and yours. Calling the police these days, is a bad idea.

So some overreaction is acceptable to avoid having police get hurt.

Maybe they just shouldn't hire little sissy boys, and hire real men instead, who aren't too worried about getting a scratch.

The police also shot a guy responding to his neighbor’s burglar alarm (on drudge report.) The police are tazer and trigger happy. I don’t want to call them for any reason. Their new culture of “everyone’s a terrorist” is murdering innocent people. Thank u, Big Sis and all the lesbian police chiefs all over the country for following her lead.

The new Gestapo, America’s police departments. They do these things because no one holds them accountable.

Never call the police.

Good Friday, 2001 I had to call an ambulance to help get Mom to the hospital.... Alzheimer's. She was refusing to take medication and getting increasingly aggitated and was going to hurt herself. (She broke her hand before they got there, but it didn't slow her down any) Cops came too. Evidently they had to accompany the EMTs on "disturbed person" calls.

Especially if you have dogs....

Cops quit being your friend about the time the Hippies nicknamed em pigs and wasted no time in earning the tag.

Unfortunately, I have been to people who died after being tazed over the years. It was not the tazer that was the primary cause of death nor injuries from the fall. The deaths were the result of being handcuffed and left face down in a way that restricted the person’s airway.

They asked him to go to the grass area, because they fully intended to taser him more safely, IMHO.

I disagree with the comments on that thread. The police did as they were trained. /sarc
