Maines highest court will soon decide which restroom Nicole Maines, a 15-year-old transgendered student, should use.
Last week the state supreme court heard oral arguments about whether a school district violated her civil rights when it forbid her from using the girls restroom. She was in fifth grade at the time.
Maines is biologically male but has identified as female since she was very young. As such, she wished to use the girls restroom. State law, however, mandates that boys and girls use separate facilities. Her school told her to use the staff restroom instead.
These requirements violate the Maine Human Rights Act, which bars gender discrimination in schools, claim the Maines family and their supporters, including the Maine Human Rights Commission and various LGBT groups.
At the core of this case is whether the promise of equal educational opportunities for transgender students is realized, said Jennifer Levi, director of the Transgender Rights Project for the Gay & Lesbian Advocates & Defenders, in a statement.
Maines said that she felt singled out and embarrassed because of the restroom policy.
I hope they understood how important it is for students to be able to go to school and get an education and have fun and make friends, and not have to worry about being bullied by students or administration, and be accepted for who they are, she said in a statement.
Maines enjoys the full support of her family, including her twin brother, who is not transgendered.
Her father was hopeful that the court would side with them.
It has been extremely difficult, but Im pleased to be here and to have our case heard, and Im very hopeful for a good outcome, said Wayne Maines in a statement.
The state supreme court is the next step for the Maines family, who lost in superior court earlier this year. The court sided with district administrators, who maintain that they are only upholding state law. To properly resolve the restroom issue for trangendered students, legislative action is required, they argued.
Reconciling transgendered students with school policies has become a thorny issue as of late. The family of a transgendered first-grader in Colorado is also suing the school district over restroom usage.
It is “disturbing the education process”.
“Maines is biologically male but has identified as female since she was very young.”
Biologically, I’m a human, but I identify as a canine. Does that mean I can urinate in public without repercussion now?
How about the one at home? Require that all self-outed queers and gender confused individuals be home schooled!
Which bathroom? ... Depends on the plumbing going through the doorway.
Not only that, but you are now free to sniff strangers’ crotches in public whenever you want, and they will pat you on the head.
IOW, take away one classroom per hallway to create another restroom. Our HS of less than 1000 students has at least 13 pairs of restrooms in the main buildings. That's not counting those in the outlaying buildings, the field houses and other sports areas. Creating these I Want Attention Restrooms would mean a loss of 13 classrooms. Then the school tax will have to be raised to rebuild those lost classrooms and to hire more custodians to clean those restrooms all for one wackadoodle kid.
Actually, the solution is quite simple: the indulged ones should use the teachers’ restroom(s). Make the fools who run the schools have to indulge these selfish, self absorbed pretenders until it galls them.
But if they did go to a separate school, then they’d be on equal footing and couldn’t drum up the drama they crave. NYC has one, the Harvey Milk HS but I don’t see how it’d work across the country because separate but equal didn’t work with segregation.
It is about the drama and attention. They don’t do anything within the norm but have to over exaggerate everything. Look at gay pride parades which are feathers and Bedazzlers gone wild. Do 99% of “normal” women speak with lisps, over exaggerate their motions and gestures, wear 6 inch heels to the store, get in your face over every little thing? No. These freaks aren’t trying to be feminine and never wanted to be feminine. It’s not about blending in with feminine or masculine traits. Never was, never will be. It’s all about taking this to extremes for the ATTENTION.
Making girls share a bathroom with a boy is not an option. If the law is decided in favor of this boy, then the girls have a right to use the teachers lounge.
Yep. Negative attention is better than no attention at all.
The father should take this boy to a psychiatrist to see why he has such a distorted need for that type of dysfunctional attention. He should do it right away while the boy still has a chance to fit into normal society.
Then some girl will claim Mr. Brown molested her in the unisex teacher’s lounge restroom.
Woof woof! *wags tail*
Who wants their daughter sharing a bathroom with a male cross-dresser/deviate, or having faggots and dykes occupying the same facilities as NORMAL children?
Perhaps there should be a mentally handicapped seperate washroom.
Abnomal behavior in minors must not be enabled by adults.
Those that do, should be arrested for some form of criminal act on a minor.
The bathroom on Mars? Hey, I'm just speculating because I heard what Sheila Jackson Lee said.
5.56mm
Perfect !
Try doing a job that includes cleaning male and female restrooms. The girl's was ALWAYS nastier, by far.
How about a third facility to be used by everyone who is reluctant to use the first, traditional, two?
Boys, Girls, Others.
A Porto-Pottie
You are a male
You are not a female
I don’t care if you want to pretend and live as a male
That is fine
But you cannot force everyone else to act as if you are a female
