Why did Marissa Alexander get a 20-year sentence despite invoking ‘Stand Your Ground’?

Late Saturday evening, George Zimmerman was found not guilty in the death of 17-year-old Trayvon Martin. The issue of self-defense played a central role in Zimmerman’s not guilty plea and his defense’s argument against the second-degree murder charges, and his acquittal is drawing comparisons in the media to the verdict of another high-profile Florida shooting incident: the case of Marissa Alexander.

Alexander, an African-American Florida woman, was sentenced to 20 years in prison in 2012 for shooting what she described as warning shots into a wall during a confrontation with her husband. Alexander’s lawyers claimed self-defense in the case, and said her husband had a history of abuse in their relationship. They invoked Florida’s “Stand Your Ground” law, which gives people the right to use lethal force if they feel their life is threatened. The jury ultimately sided with prosecutors in deciding Alexander’s actions were not in self-defense, WJXT reported...

Probably because the same dim bulb prosecuted both of them. Namely, Angela Corey.

Secondly, one of the charges she faced was endangering her children who were in the next room when she fired into the wall.

Because, as I understand it, she went outside to her car to get the gun before returning inside the house. Once she left the scene of the altercation, she could not re-enter and still claim STG/self-defense. That’s why she was convicted.

If this is the case I’m thinking of, she left the house where the guy was, went to her car to get a gun, and went back into the house to confront him. No way was it SYG. And it was light years different than the Zimmerman/Martin incident.

Legally there are no such things as warning shots. Any shot fired during a confrontation is an attempted use of deadly force. Next question: Did she have a reasonable fear of death or great bodily harm, which is the threshold for self-defense in Florida? No facts here to tell.

I would.

From what I understand, She ran out to car to get her pistol, then ran back in to fire her “warning shot.”

Once she was out, she wasn’t in danger any more. Running BACK to danger is what made it something other than “stand your ground” or “self defense.”

Marissa Alexander's husband says it was her violent nature that led to shooting

The husband of Marissa Alexander said Wednesday it was her violent nature, not his, that ultimately landed her 20 years in prison.

"I never put my hands on Marissa Alexander," said 36-year-old Rico Gray, accompanied by his 12-year-old son when he spoke with the media Wednesday at the State Attorney's Office in Jacksonville.

Gray said he put his hands up in defense "buying time" for his two sons to gather their belongings so he could take them and leave. But when he made the remark that their newborn baby must be fathered by her ex-husband, he said she immediately stopped.

"She said, 'I got something for your — —,' and walked away," Gray said. "I knew exactly what she was going to do."

Gray said she went to the garage, to her truck, to get her gun and then returned back inside the home. He said the garage door that she claimed was inoperable worked for him earlier that morning and later that day with no trouble.

"When she came back inside, the first thing I saw was her putting one [a bullet] in the chamber," he said.

Why did it happen to Ronald Thompson?

Unlike for Marissa Alexander, there have been no public rallies or elected officials protesting Ronald Thompson being sentenced to 20 years in prison for firing what could be described as a warning shot.

Thompson is a fully disabled Army veteran of 14 years with, among other ailments, diabetes, heart disease and severe vision problems.

This is a bogus portrayal.

She left and got her gun and then fired the “warning shot” into the wall behind her husband and children- at head height.

I’n surprised even our media would be so blatantly dishonest. Usually they have some facts to push “the agenda” with, something to hang it on.
Here, it’s just agenda with no cover.

Since both of them were in their own home, stand your ground wouldn’t apply here. Heck yeah, she was angry and trying to scare him in front of the kids. What if the bullet had ricocheted and hit one of the children? She should have left until she calmed down. She’s lucky she wasn’t also charged with endangering the life of a child.

Angela Corey is prosecuting self defense and getting convictions, I think in an effort to overturn SYG or make it of no effect. She was the prosector in this case as well.

I believe Thompson has a new trial coming courtesy of bad jury instructions.

What MSNBC left out the fact that she fired a gun after she started the fight. Stand your ground doesn't apply. Don't you love it when you catch a Liberal/progressive liar...

Prosecutor Nick Lake said following the hearing, "The jury decided she was not in fear when she fired the gun. She went back to his house, alone, and committed a domestic battery on him (ex-husband).
