I'm not sure the judge has standing. She's an Ingam county judge, not a Wayne county judge. I do think its funny that she's telling Obama on us.

Aquilina said she would make sure President Obama got a copy of her order.

“I know he’s watching this,” she said, predicting the president ultimately will have to take action to make sure existing pension commitments are honored.

With rumors it was eminent Thursday afternoon, attorneys representing the pension boards hurried into Aquilina’s court in Lansing to ask for a temporary restraining order.

But Snyder and Orr beat them by a few minutes. Aquilina,
informed by phone, allowed the pension board lawyers to revise their restraining order request, then granted it.

Prior to her ruling on Friday, the judge criticized the Snyder administration and Attorney General’s Office over its hasty move to outflank pension board attorneys.

“It’s cheating, sir, and it’s cheating good people who work,” the judge told assistant Attorney General Brian Devlin. “It’s also not honoring the (United States) president, who took (Detroit’s auto companies) out of bankruptcy.”

Aquilina said she would make sure President Obama got a copy of her order.

Yes. She is saying that the Michigan State Constitution bars Detroit from filing bankruptcy. I predict that the federal bankruptcy court will tell her to pound sand, because state laws cannot trump federal laws, and the federal bankruptcy code permits municipal bankruptcies. (Actually, federal law puts a number of conditions on municipal bankruptcies, and there is a possibility that Detroit's filing won't qualify, but if so, it will be because Detroit didn't satisfy the requirements of federal law, not because of the Michigan Constitution.)

(Reuters) - Detroit’s historic municipal bankruptcy filing on Thursday came less than 10 minutes before lawyers for the city’s pension funds and retirees had rushed to another court to try to block it.

The bare bones bankruptcy petition, which came at 4:06:22 p.m., blindsided everyone in the room, according to two lawyers who were in state court in Lansing, Michigan, at the time. Even the lawyer representing the governor and the judge were caught unaware.
