Should Mickey be suing the makers of mac and cheese?

Ridiculous. The term “Mac” (or diminutive “Mc”) means “Son” in English. Should the entire McDonald clan now turn around and sue Ray Kroc’s company, whose name he bought from two members of that clan?

But in his decision this month, Justice Roger Hughes found Mr. Cheah’s true motivations in seeking to register the name was to seek business opportunities with McDonald’s. The judge referred to a 2008 letter to McDonald’s in which Mr. Cheah suggested “…we can together perhaps explore the possibilities of a global MACDIMSUM partnership.”

How did that work out for you, Mr. Cheah?

Look... me and the McDonald’s people got this little misunderstanding. See, they’re McDonald’s... I’m McDowell’s. They got the Golden Arches, mine is the Golden Arcs. They got the Big Mac, I got the Big Mick. We both got two all-beef patties, special sauce, lettuce, cheese, pickles and onions, but their buns have sesame seeds. My buns have no seeds.

Here in Russia, they sell something called “MacCoffee,” which is an instant 3-1 coffee (coffee, sugar and powdered milk). The product is from Indonesia. I've often wondered how they got away with the name. I always figured that McDonalds would have sued them.

As a practicingtrademark attorney, I can assure you that this is a correct ruling.

McDonalds owns the prefix Mc for food and related services.

It’s clear that these guys were making a play on McDonalds’ trademark, intending that customers make the association.

Idiot coffee shop ownershave been doing the same with Starbickd, and losing as they should.
