Simple, really. It was a libelous statement made in a book authored by Chris Kyle that can't be substantiated by any witnesses.........
To put it into perspective for you, how about if I write a book detailing my experiences with FReepers on this site and say that I witnessed GeronL having sex with an underage male in a back room at a FReeper convention? No witnesses, just my word about GeronL in my book............How ya gonna react?
Of course we all know, even you, how you're gonna react. You're gonna sue me for libel and demand I produce witnesses aren't you? Well? Aren' you?..........LOL!
So, Kyle will be required to produce witnesses?
He is dead. Put a dead man on the stand and cross examine him!
That makes sense.
I'm sorry, but how in the world to you equate claiming someone committed a felony with the supposed winner of a bar fight? I know where you were trying to go with this, but really, when you're trying to put things in perspective, it might be best to actually put them in perspective rather than choose an example that is grossly different.
To put it in perspective, you write a book claiming in high school GeronL was beaten up by a geek.
In other words, you'd really have to go far to actually demonstrate that there is any loss in the first place. The issue died with the accuser. Jesse Ventura is doing himself more harm than any possible clearing of his name could possibly gain by suing the widow of his accuser.
this suit would have been tossed by an honest broker of law ... as it likely would be in Texas
