The utility says it needs the money to compensate shareholders.
Marc Toney, Executive Director of The Utility Reform Network, is among those who have publicly criticized the proposal.
We think that Southern California customers should not have to pay for Edisons mistakes, Toney said. We think, in fact, customers deserve a refund for hundreds of millions of dollars already spent on replacement power in the last two years of paying for an idle plant.

Let them sue Mitsubishi for bad equipment/design. Why is it that utilities always get to dump their business mistakes or cost of infrastructure onto the backs of utility users. If you fail to do maintenance on your car and damage results do you get to go to the loan company and request a reduction in your balance or payments?

Apparently both Edison and Mitsubishi decided not to make design changes, i.e improvements because it would have resulted in more revue and inspections.
Exactly. It was some fairly new tubes provided by Mitsubishi Heavy Industries that developed leaks that caused the whole thing in the first place.
Many times this is the tipping point in business decisions. Repair and maintenance work is easy to calculate and pay for, amortized as a capital expenditure. Dealing with environmentalists is an expense that cannot be calculated with any precision and carries a high risk. So yes, when it is all said and done, rate payers need to pay for their service which includes many costs. This is a government regulated industry. Gumit has a strong hand in limiting profits to keep rates low. Now it is time to pony up and keep service going.
