Judge: Strippers Must Be Paid At Least Minimum Wage

A federal judge ruled this week that exotic dancers at a Midtown strip club are protected by labor laws and entitled to be paid at least a minimum wage.

The ruling came Tuesday in a class-action lawsuit brought by current and former dancers at Rick’s Cabaret, at 50 W. 33rd St. The lawsuit against Peregrine Enterprises – the subsidiary that operates the club – and the club’s Houston-based parent company, charged that the strippers were denied wages and required to pay a variety of fees to the club.

The club had argued that the dancers were independent contractors....

Don’t the clubs have a waiting list of girls? So the girls pay to get stage time, like a band would. And if the girls don’t like their times, they cancel, and other girls take their time slots.

Even a pub’s “house band” is generally an independent contractor, and could simply stop showing up at any time, but then they would lose their slots.

Really? You are in favor of the government setting wages?

In this case yes to prevent exploitation/prostitution. Are you in favor of indentured servitude and/or sex slavery?

Well, here in NW Washington , one bunch of clubs owned by a certain family, didnt pay the girls anything, but charged them a fee to dance. So they had to make a certain amount to get out of the red. They didnt put a limit on how many could dance on a given night. So you can see why they got very high-pressure selling lap dances and so forth. The government has no business imposing a minimum wage, though, however well-intentioned. In King Co. they imposed a “4-foot rule”, meaning dancers and patrons had to stay 4 feet apart. Pretty hard doing a lap dance at that distance. Maybe it was Snohomish Co. and a 3 foot rule. Something like that.
Now that their patriarch has died, the family went into the bikini barista business. But their coffee stands got busted for being fronts for prostitution. A law officer also got in trouble for tipping them off with text messages when busts were iminent, etc. Apparently he received sexual favors for this.

And all of that has provided me with a great deal of amusement over the years. My favorite coffee stand is still the one on Hwy99 just north of O’Finnigans. They are the only one that’s open 24/7. I have to applaude their entrepenurial spirit.

Nope, 1099’ers are essentially employees. The funny, however, is the concern about making minimum wage. The not-so-funny is the insurance requirements.

According to an accountant I knew, the IRS (at least once upon a time) would have certain criteria for contractors and 1099 employees. One method of determining the actual status of the employee was if they were using their own tools or if the employeer was providing them. If you come with your own tools and equipment, you are a self-employed contractor and have to pray estimated taxes and self-ekployment tax.

So will the employer have to provide g-strings, pasties, and 6” spike heels? Feather boas?

Now I am really curious... the Tijauna Donkey show is the Donkey equipment provide by the club or is the donkey an IC as well... oh that’s a
Mexico...

Don’t know. It’s been over 35 years since I spent any time in a topless bar. And at the time I wasn’t too concerned with the employment agreements the “dancers” had with the club.

I actually didnt expect FR to approve that post.
Have you heard that a 12 year old boy was arrested for holding up the bikini barista stand( and at least one other business) at 41st and Hoyt? His mother made a scene in the courtroom. I’ll try to post it. I think they actually mean 41st and Rucker.
The most over the top had to be Saints and Sinners at Broadway and 21st. The girls weren’t discreet at all,Iounging in skimpy bikinis in the window in the middle of the day. I was walking to Safeway and felt like I was in Amsterdam.
