I would say a court case quickly brews out of this. If you can’t cite law, and just say it’s some EPA-contrived rule...then states will merely grin and pass a law that forbids the EPA from enforcing it in their state. The EPA will sue, and off to the Supremes we go.
You just end up with more lawyers on the EPA staff....running cases for a year or two....and judges sitting there and shaking their heads over something that isn’t law.
Meanwhile, Republican “leadership” in Congress is hiding under their respective desks in wet trousers.
Makes it pretty clear that environmental whackos are writing at least half the checks to Democrat election campaigns.
