Students Suspended For Playing With Pellet Gun in Own Front Yard, One Mother Called Because It Made
Reason.com ^

WAVY, the NBC affiliate in Hampton Roads, Virginia asks “has zero tolerance gone too far?” as it reports this story:

A suspended seventh grade Virginia Beach student will find out soon if he is expelled for the rest of the year for shooting an airsoft gun.

Like thousands of others in Hampton Roads, Khalid Caraballo plays with airsoft guns. Caraballo and his friend Aidan were suspended because they shot two other friends who were with them while playing with the guns as they waited for the school bus.

The two seventh graders say they never went to the bus stop; they fired the airsoft guns while on Caraballo's private property.

Aidan’s father, Tim Clark, told WAVY.com what happened next lacks commons sense. The children were suspended for possession, handling and use of a firearm. The “fire” in firearm, of course, refers to gunpowder, which a pellet gun doesn’t have. Six children were playing in the Caraballo front yard all together, and the school suspended three it said had discharged the “firearm” near the school bus stop. The school found out about the kids playing around because a neighbor, the mother of one of the children not suspended, called 911. WAVY tracked her down:

They should be homeschooled or in a private or parochial school anyhow. Problem solved.

Let’s be very clear. This is NOT a lack of common sense. this is purposefully brainwashing the children of American into being afraid of guns.

The mother who called 911 needs to be publicly flogged. The principle who suspended the boys needs to also be publicly flogged.

These people are idiots and need to have the idiocy beaten out of them.

Spot on!

We need to do away with our socialized, single payer, school system and replace it with a free market system.

The trouble is, far too many people refuse to give up their entitlement.

A Pellet Gun and a Airsoft Gun are two different types of gun. The only similarity is they use air and springs.

Another thread on this quotes a letter from the school, that the boys shot other children at the bus stop with pellets, in which case doing it from their own yard is no excuse at all, and there should be criminal prosecution as well as school suspension.

I’m a big believer in public flogging. I’d also like to see the stocks brought back; public humiliation is a great corrective tool.

“The zombies are getting their revenge.”

I disagree.

Matter of fact, that rumbling sound in the distance is probably a stampeding herd of lawyers, all at a dead run towards the home of the parents of that boy.

OMG, you are right. Look at how horrible our public schools have become. And we are now facing socialized, single payer medicine. The analogy between schools and medicine is chilling. Neither will end well if we, as a country, stay on this path.

An update:

During a hearing Tuesday morning, Aidan Clark and Khalid Caraballo were expelled in a unanimous vote. Clark was offered the option of attending an alternative school, but his father, Tim, told WAVY News' Andy Fox he will be homeschooled.
Caraballo will attend an alternative school.

One thing need to be perfectly clear. This was not a firearm. This "toy" has never been classified as a firearm, will not fire any gunpowder cartridge of any kind. It is much less powerful than a BB gun and a lot less powerful than any compressed air pellet gun designed to shoot metal pellets.

This toy is made to shoot a very small light weight plastic pellet and a very low velocity. You can do much more damage to someone or something with a child's slingshot.

If you go to the link and look at the picture of the kid holding this "toy", you can clearly see that the muzzle is orange. That is how Toys must be marked so law enforcement knows the difference when they respond to a stupid and ridiculous call like this one.

If my child had one of these on my property and the school or a neighbor publicly stated that he/she had a firearm I would sue the crap out of them. It is not a firearm under any nomenclature, law, or known definition.

Anyone claiming that this is a firearm is guilty of telling a bold faced outright lie. Stupid people?? No, these are left wingers with an anti gun agenda and they and the media who reported it as a firearm are just liars.

More evidence of the stupidity of the media - a pellet gun and an airsoft gun are very different beasts.

But lets get back to the story’s core - these kids were playing with an AIRSOFT gun, AT THEIR HOME - NOT AT SCHOOL... and got suspended (and may be expelled) from school? Might be the best thing to happen to those boys! That school obviously isn’t someplace I would want my children.

I know quite a few young folks who play paintball regularly - should they too be suspended/expelled from school?

ARGH!!!!

Zero tolerance, sensitivity training, political correctness nonsense is literally straight out of a North Korean prison camp. It was scientifically developed and tested on American POWs during and after the Korean War.

Thank you. The obfuscation about guns is rampant enough in the powder-burner world - let's at least try to get it right when referring to airguns.

But again - we have inconsistencies - pellet gun or airsoft? And no - I do not condone shooting other children with anything (outside of them being active and willing participants in a game).

Most states consider bus stops to be “school property” for the intent of school children. IF this is the case - and these boys were shooting kids getting off the bus - then something needs to be done.

But I’m not yet convinced that expulsion is the answer.

Shooting each other is the whole purpose of an airsoft gun.

Its intended use is by kids to shoot one another.

Idiocy like this should not be free. The mother who called 911 needs to be identified and held up to public ridicule. The principal and those others involved to suspend these students need to be sued and a gun rights legal defense group needs to fund the legal action. Finally, each of these idiots needs to have their own backgrounds checked to see what might be useful in the continued culture war for America.

I agree. What law in any state gives the school district jurisdiction to tell you what you can and can’t do on your own private property. Are people really that stupid to think the school district has legal standing in this case?

By the time it hits CNN, the weapon in question will be “A fully-automatic assault AK-47 machine-BB gun”. furthermore, they’ll probably claim that the kid bought it at one of those “unregulated Texas gun shows where they sell weapons to escaped mental patients, kids and blind terrorists”.

It was probably an assault-style airsoft weapon. The journalist must be having a bad day to have not thrown that into the horrible account of what the terrorized children, and that mother of a neighbor, had to endure.

One of these days the media is going to be right when they report a pissed off right winger went off his rocker with a REAL gun.

When I was a kid we’d go into the woods and play war with BB guns. And no one lost an eye.

When I was 14, I could walk all over town with a .22 rifle, no problem.
Cop would drive by, he'd just wave at me.
Now, a 14 year old with a .22 would be Swat-Teamed.

And there's another problem. The term 'Swat Team' being turned into a verb.

“When I was a kid we’d go into the woods and play war with BB guns. And no one lost an eye.”

Back in the idyllic ‘50s when I was a lad, more to be feared than BB gun fights were rock fights - they were sometimes very scary.

Luckily, rocks are no longer available to our youth...

I think it should be treated like a kid who is throwing sticks or pepples at another kid.

If no one was hurt (like blinded by gettng shot in the face), then the matter should be handled at home.

If someone was blinded, the parents should pay medical bills. Not sure what should be done to stupd kids.

If the kids did it on purpose (aiming at someone’s face), then I think something should be done to the kids.

I would feel the same way if some kid was aiming and throwng sticks at another kid’s face with the intent to harm.

The mother who called 911 needs to be publicly flogged.

She needs to be shunned - the entire neighborhood needs to divide between decent people who pretend that she and her children do not exist and the parasites who cower in fear with their tattletale leader. The whining mother needs to be excluded from decent society, and her children need to be shunned as well. Good people cannot lie down with dogs, or we (and our kids) will get up with fleas.

"Not once the school brings up that he was suspended for shooting and hitting kids waiting at a nearby school bus stop."

The article doesn't actually say that. The language is slippery. See quote following: "Six children were playing in the Caraballo front yard all together, and the school suspended three it said had discharged the “firearm” near the school bus stop." Don't know what really happened, but I wouldn't put it past the school to shade the truth, especially when challenged publicly.
