How to Constitutionally Fund the Government

Republican leaders are right: There was a flaw in Ted Cruz’s plan to defund Obamacare: He took Republican leaders seriously.

Senator Cruz, along with Senator Mike Lee and House conservatives, devised a strategy to forestall the unpopular socialized-medicine scheme that Democrats unilaterally rammed through Congress in 2010.

[snip] A little over a week ago, with the October 1 implementation of Obamacare looming, the House voted not to fund the massive and massively unprepared program. This House bill has been scorned by the GOP establishment and its sympathetic scribes. Echoing Beltway oracle Charles Krauthammer, they tut-tut that Republicans only control “one half of one third of the government”; therefore, the refrain goes, they cannot reasonably expect to impose their policy preferences on an electorate that has placed the White House and Senate under Democratic control.

[snip] The Constitution expressly provides (in Article I, Section 7): “All bills for raising Revenue shall originate in the House of Representatives.” This Origination Clause applies to all spending legislation. As the clause elaborates, when the subject at issue involves spending public money, the Senate “may propose or concur with Amendments as on other Bills”; but it may not instigate spending. The Senate can tinker within the spending limits set by the House, but it must live within those limits. The continuing resolution to fund the government, which is the legislation at issue in the current controversy, is no exception. The Senate is not permitted to originate spending, as Majority Leader Harry Reid did on Friday, with the indulgence of Senate Republicans — who voted against his appropriation of Obamacare funds but did not challenge the validity of it.

....therein lies the rub, at least part of it.....Republicans did not challenge the validity....

Senator Cruz has been trying desperately trying to save our tattered Constitution which Obamacare will ultimately diminish it's remaining strength......It is the Constitution folks and the Tea Party which the 'Reidites' are terrified of....Obamacare is Thoroughly ANTI-CONSTITUTION AND THOROUGHLY TOXIC!

I make this the third of a series of articles by Andy McCarthy on the subject of defunding Obamacare. These three articles represent the clearest thinking that I have encountered on the subject.

We all know that low information voters have absolutely no interest in the constitutional foundation upon which this republic rests and to them Andy McCarthy's cogent analysis might as well not have been written. But there are some things which come from the bottom up and some things which trickle down from the top.

A political campaign cannot ultimately succeed if it is grounded on nothing more than counting noses, it must first have intellectual integrity which provides the indispensable foundation upon which an emotional appeal can be launched. Andy McCarthy here provides the intellectual and constitutional foundation so necessary for a political campaign to prosper.

We are fortunate in Ted Cruz that we have a man leading this cause who is fully grounded in the Constitution and who is fortunately fully in accord with Andy McCarthy's analysis. More, he can reach beyond a dry constitutional analysis and speak a language to low information voters which they can understand and, crucially, appeal to their emotions.

In other words, first we find out what's constitutional and then we tell them why it's good.

Correction: The senate is not EMPOWERED to originate spending. They are obviously permitted to do so, because... ...well, because they've been permitted to do so.

The bushes(ALL OF THEM) are one worlders..
They WANT one world givernment.. always have...

Reagan was arm twisted into selecting Bush Sr. as VeeP..
Many forget that... The Bushes are enemies of the Republic..
AND............................ made the Obama election POSSIBLE...

And Romney was and is even WORSE..
