Insurers Angrily Attack Obama's Health Care 'fix' To Reinstate Canceled Policies
Mail Online ^ | 15 November 2013 | David Martosko

Health insurance companies are crying foul over new measures President Obama announced Thursday as a political tweak to his fast-disintegrating Affordable Care Act, making the fix potentially worse than the problem.

'This whole thing – it's a mess,' an insurance company official told MailOnline, speaking on background. 'With six weeks left before New Year's, I don't know how the White House expects us to fix what's already happened.'

Obama 'kind of threw us under the bus today,' one of the regulators told The New York Times.

'The president’s "administrative fix" is an attempt to create a lifeboat for ObamaCare to get his party through the 2014-midterm elections,' said South Carolina Republican Rep. Jeff Duncan. 'The president’s actions appear to be unconstitutional.'

Obama's new plan, the insurance companies fret, won't magically fix things for the estimated 5 million people who are already affected.

And some in the industry believe that Obama is setting them up to be the fall guys if the latest flavor-of-the-month tweak to Obamacare sours.

What if 0bozo says "You won't be prosecuted, period?"

I think the insurance companies' lawyers will say, "If you like your presidency, you can keep it. Period."

So... is the President TELLING insurers to disobey the law? Or is he ORDERING them to?

And are they just supposed to hear it on TV and act without something in writing?

Why would any insurance company sell an “illegal policy” at this point?

They won't. Which means that Obama's administrative "fix" is for naught.

Neither. He's promising them that he'll exercise "prosecutorial discretion" should they choose to violate the ACA by rewriting (now) illegal health care plans.

It's a clear violation of Article II, Section 3 of the Constitution. No insurer in their right mind is going to take him up on his offer.

Obama's 'fix' sounds like something he dreamed up on his own, which is why it's so laughable.

For someone who was once a lawyer, and who is rumored to have been a constitutional lecturer, he shows a shocking lack of understanding of basic legal principles.

Almost forgot....

Full title: ‘This whole thing – it’s a mess!’ Insurers angrily attack Obama’s health care ‘fix’ to reinstate canceled policies . . . and it might be illegal

He really does. Even taking into consideration that he's a leftist trying to spin the meaning of the law for his agenda it's apparent from the clumsiness of it that he has little grasp of the law.

Can you imagine an insurer ending up in court in a dispute with a policyholder and it is pointed out the policy was illegal? If the insurer says “0bama said we could sell this policy”. The Judge would say something like “0bama isn’t here and he doesn’t run my courtroom or get to tell me what the law is.”

No insurance company will sell these policies.

Not everyone who's supported Obama these last five years is a brain dead, liberally indoctrinated zombie (although that's debatable). Some Dems are actually quite intelligent and very well educated.

I can only imagine the gasps of horror that must be emanating from some of their mouths right now. A lot of the upper crust of the liberal elite must be privately horrified at what he's doing lately. I mean, it's more and more obvious to everyone with half a brain that, 'the Emperor has no clothes.'

Imagine how congressional Dems must be feeling, watching this all go down. I can only imagine the range of emotions and analytical conclusions they must be experiencing. Everything from, "My President right or wrong", to, "Who the f**k is this bastard, and what the hell has he done to us?"

Once policies are cancelled; they are cancelled. You have to get a new one.

Ain't gonna happen, because none of them will be stupid enough to take Obama up on his offer.

Those who've had their plans cancelled are not getting them back, and vulnerable Dems who are up for re-election can kiss their hopes for retaining their seats good bye.

You fail yet again, master Obama.

I guess Obama's going to have to read about it in the papers to find out his 'fix' won't work.

All along. They have had to bite their tongues, swallow their pride and defend a one trick pony for a long time. It makes me happy to think about that. :-)

This is becoming a farce. I blame the press. Obama is so used to the idea he can do or say anything without serious criticism from the press, he thinks he can just make up laws as he goes along, snap his fingers and everything will be fixed. DAMN the MSM.

Some poor mousy Progressive intern is probably charged with making sure 0bama doesn't find any newspapers or magazines and has to make excuses for their perpetual absence. Her saving grace is 0bungle's chronic incuriousness so he probably rarely asks about it.

Obama just shows he is clueless. This is a law three years in the making, and a month into its implementation, he’s trying to do a song-and-dance to allow people to violate specific provisions of HIS law. You can’t do that. Policies and rules do not switch overnight, they require planning, they have consequences, and you cannot ask people to do two different things - under the rule of law - at the same time. It is utter incompetence and lawlessness.

True, but this time it's different. People all across the nation are being hurt by Obama's health care law - and the pain traverses all political boundaries and social strata.

The press can try to cover for him by omitting data or smoothing over his prickliest missteps, but mere words can't relieve the real suffering and bone crushing worry that Americans of every stripe are experiencing right now.

Obama promoted this gargantuan transformation of our health care system for years before its passage, and it now bears his name. There is no way he can escape the repercussions and blow-back from its ill effects on the populace.

And because his subservient minions in Congress voted in lockstep for it, without a single Republican's help, they too own its disastrous effects on people's personal lives.

A reckoning is coming, and the DemoSocialists are going to have hell to pay for it.

Come on, now. You can't blame Obie for that. His staff haven't shown him the U.S. Constitution yet. How was he to know?

“Obama kind of threw us under the bus today”

Anyone who saw the movie ‘Van Helsing’ may remember the scene where ‘Igor’ was tormenting the Werewolf (and one heck of a fine one too) with a strong electric prod.
So Dracula asks him, “Why must you provoke the creature so?”
And Igor replies, “It’s what I do.”

So the answer to your predicament, insurers, is—that’s what he does.
