Navajo fight is set over same-sex unions

New Mexico has seen celebrations across the state since its highest court unanimously ruled it was unconstitutional to deny a marriage license to same-sex couples. Not so for the sovereign Navajo Nation, whose borders spill over into the northeastern part of the state and where tribal law is clear: Such unions are banned.

Some Navajo hope to change that, buoyed by the cultural climate shift underscored when the U.S. Supreme Court in June struck down part of the federal Defense of Marriage Act. Gay marriage is permitted in the District of Columbia and 18 states, the most recent being Utah, although officials there are appealing a federal court decision that overturned the state’s ban on same-sex marriage.

For Navajo activists, it won’t be easy.

The Dine Marriage Act, passed in 2005 by the Navajo Nation Council, defines marriage as a relationship between a man and a woman and declares polygamy, unions between family members and same-sex marriages “void and prohibited.”

A grass-roots attempt to block it from becoming law failed when the legislature overrode a veto from the Navajo Nation’s then-president, Joe Shirley Jr.

Same sex unions are not marriages, and will never be such.

It is merely Government permission to perform perverted acts upon another person of the same sex.

There can be no corner of the United States that does not bow to the whims of the homosexual bullies. It kind of makes me want to send them on vacations to Arab nations to see how they are treated in other parts of the world.

They get to pay higher tax rates, enjoy marriage penalties... and trial lawyers want it because it is an untapped divorce court mecca. Yes, there have been many homosexual divorces and from what I have read... they are cruel and evil when they happen. Hell hath no furry like a satanic union split.

The oil-rich or casino-rich tribal nations should tell the homosexual/federal government alliance to pound sand. The welfare-funded tribes will have to bow to the bullies to keep the checks coming.

It’s not clear what actual impact the tribe’s law has vs. state law. Some tribal benefits at stake, perhaps? A homosexual (or polygamist) “marriage” legal in the state is relevant for anything not specifically tribal ... insurance, banking, all that.

The Navajo have a definition of “incest” that’s broader than practically any other known; a couple who have no traceable blood relationship can be “clan siblings” and their relationship “incest.” I wonder what they do now regarding couples who are legally married in the State, and even married in church, but are “siblings” by the tribal definition.

The Dine are a nation of their own. No US judge has any authority there.

But then that’s in a treaty and we all know what a good job the feds do of abiding by their treaties

This isn’t important, I can’t believe they included it in the article.

What’s important is a cable reality TV star getting fired/suspended for saying he thinks homosexual acts are gross and sinful right before the Christmas merchandise selling season and then re-hired right before the new season of the cable reality TV show starts up again. This whole thing about actual states being forced to accept ‘gay marriage’ despite one of them having a marriage amendment is nothing but piffle that will no doubt be long forgotten about before the next cable TV reality star gets fired right before next Christmas for expressing an opinion that doesn’t support the gayness.

The author needs to learn to read a map. The Navajo reservation, which is mostly in Arizona, extends into the northwest corner of New Mexico.

Any gay member of the Navajo tribe can LEAVE the reservation & live in white man’s world if they want to marry.

The tribe has the right to have their own laws on their own land.

Dine are Dine when they live on the Dinetah and follow the way. A Dine couple would marry according to tradition.

If they didn't, it wouldn't matter.
