US Judge Hears Challenge To Mich. Gay Marriage Ban

LANSING, Mich. (AP) - A federal judge is considering a U.S. constitutional challenge to a voter-approved 2004 amendment to the Michigan Constitution that ban's same sex marriages.

Similar challenges are working their way through courts around the country.

In less than a month, federal judges in Oklahoma and Utah have struck down state bans on gay marriage for the same reason, concluding that they violate the U.S. Constitution's promise of equal treatment under the law.

When did come to a point that a federal judge can overturn a STATE constitution???

Eventually, a state is going to say FU to a federal judge, arrest him and dare the feds to come and get him.

When and if Americans realize it is useless to try to overturn the will of the elites through the political process, perhaps they will decide the country is no longer worth preserving. On the other hand, perhaps they will just submit to tyranny, as ancient Rome did.

As mentioned in related threads, and pro-gay PC interpretations of the 14th Amendment’s equal protections clause aside, the states have never amended the Constitution to expressly protect so-called gay rights. So the states are actually free to make 10th Amendment-protected laws that discriminate against gays, laws that prohibit gay marriage for example, as long as such laws don’t abridge the constitutionally enumerated rights of gays.

If it’s in the Michigan Constitution, that’s the final word in Michigan. Judges who don’t understand that don’t belong on the bench, or in the bar.

The progs sold America the snake oil of democracy 101 years ago. We have so much democracy that lawmaking no longer resides with congress, state legislatures, or via the people in state constitutions.

Black-robes, El Presidente and the administrative state, all three of which are for practical purposes unaccountable for their crimes, make the law.

Two nights ago, Obama so much as told the world he would, if necessary, rule by executive decree.

Yesterday, the House all but gave up the power of the purse. If Obama didn't get all of the spending he wanted, he promised to “shut down” the government and blame the pubbies.

Are we not where the Framers feared? Are we still a free people?

US elections increasingly serve to condone tyranny and nothing more.
