Rand Paul Suing President Obama

February 11, 2014 - 1:24 pm

Rand Paul’s political action committee just announced that the Kentucky senator is suing President Obama.

Paul will file his lawsuit on Wednesday morning at the U.S. District Court in D.C., joined by former Virginia Attorney General Ken Cuccinelli and FreedomWorks president Matt Kibbe.

The class-action lawsuit will be filed against Obama, Director of National Intelligence James Clapper, Director of the National Security Agency Keith Alexander and FBI Director James Comey.

The complaint? “I am filing a lawsuit against President Barack Obama because he has publicly refused to stop a clear and continuing violation of the 4th Amendment,” Paul said in a statement. “The Bill of Rights protects all citizens from general warrants. I expect this case to go all the way to the Supreme Court and I predict the American people will win.”

Cuccinelli, acting as lead counsel, said he’s “excited” about the opportunity “to get the courts to affirm the rights protected by the 4th Amendment to the Constitution.”

“We have assembled a legal team and we expect to be opposed by the vast resources of the federal government, yet I am optimistic that we will prevail, because we are seeking to protect a cornerstone of the Constitution,” added Cuccinelli, who was defeated in the Virginia governor’s race last fall by Terry McAuliffe.

“This class action suit isn’t about Republican versus Democrat, or progressive versus conservative. This is about defending the basic civil liberties of every American from a government that has crossed the line. FreedomWorks is participating in this suit on behalf of our community of 6 million citizens nationwide, along with any American who has a phone,” Kibbe said. “If you use a phone, you should care about this case. Never in American history has there been such a warrantless gathering of citizens information. We believe it is time to put this before the courts. ”

Paul, Cuccinelli and Kibbe are expected to discuss their case in greater detail on the steps of the courthouse tomorrow after filing the lawsuit.

Between the two of them I seriously they’re going off half cocked on this, neither are dummies.

Agreed, these guys are sharp and high profile. They get air time and news coverage, especially Paul. The media will be hard pressed to bury this story once it gets going, IMO.

[ In other words, Russia has a better Marxist socialist than we do...

They also have a 13% flat tax, a net positive native population growth and are undergoing a Christian revival, so I guess its a matter of some interpretation how “Marxist” the Russian system is. ]

It is more Czarist than Marxist at this point...

Which means it is better than the former USSR... but that is about it... Sadly it may get better there than here...

If I had to choose between Obama and Putin for President, I would vote for Putin.

The first order of business after the next congress is sworn in should be impeachment of obama.

I second that motion to the nth degree (Xn).

Standing may actually be a good point. Usually you have to show harm done to your own person to be heard.

I guess any lawful citizen with a phone has standing

I suppose, but you have to prove personal harm, so hopefully they have that.

There’s a lot to like about Rand. He comes across more level-headed than his dad, who was actually a very smart guy and understood the dynamics and benefits of the free market like few others. But in a national forum, Ron Paul would just zing off into never-never land. I hope Rand has a more sensible foreign policy approach than his dad, becasue Rand’s domestic view is spot on IMO.

With Ken Cuccinelli as lead counsel, the standing and personal harm elements are locked down, or he wouldn’t be involved. IMO.

Thus the declaration of a class-action. We’ll see.

...Anything to stop this SOB in his tracks. His arrogance is only outdone by his narcissism. (I know...they both mean the same thing...which means there is no end to Obama’s tyrannical actions.) Paul along with a few others, Cruz, etc.... they can take this guy on and win. But Obama has powerful allies and so this needs to be done right.

***we expect to be opposed by the vast resources of the federal government, yet I am optimistic that we will prevail***

Listening to Rush today [Wednesday, Feb. 12, 2014] I hear him shadowing what I have been saying for a few years: we are seeing STALINISM instituted in order to terminate our Constitutional Republic.

Rush has not really touched on the latest crushing of the Constitution: the executive passing his own law penalizing any company that cuts employees in the wake of Obama Care in order to remain in business. How can one be penalized for violating a law that has not been legally passed? Well, we will see.

Senator Paul is filing his suit in the DC Fed Court - the very court that Harry Reid has made possible for the WH to stack in its favor.

Now, in light of all that I am implying here, I say again [What Rush said today]: What will make Ob@ma leave office in January of 2017? And, even if Hildebeest does win an election, Ob@ma may rule as Putin did in Russia recently - by proxy.

The point of all this is: Who is opposing this power grab in violation of the Constitution? AND - Who trusts the Federal Courts & the SCOTUS to protect the Constitution? Who believes in John Roberts any longer?

We need to do like they did in Egypt last year: take to the streets in the tens of millions! Stop the country from functioning until Constitutional freedom is restored. Ha! There are not that many Americans willing to make the effort! How odd that Egypt has to teach the United States how to preserve some semblance of freedom.
