UAW challenges result of Tennessee VW plant union vote

The United Auto Workers filed an appeal with the U.S. government on Friday, asking it to set aside the results of an election last week in which workers at a Tennessee Volkswagen (VOWG_p.DE) plant voted not to join the union.

Citing what it called "interference by politicians and outside special interest groups," the UAW said the U.S. National Labor Relations Board would investigate the election and decide if there are grounds to scrap it and hold a new one.

The move by the union escalates a battle with anti-union Republicans that has intensified as the UAW, its membership rolls in decline, has tried hard to organize workers at foreign-owned, non-union auto plants across the American South.

Labor lawyers and academics said last week it would be difficult for the union to make a case for setting aside the election. They said labor law does not limit what can be said in a union election campaign by politicians, as long as they are stating their own views and not doing the bidding of management.

The law does strictly limit the statements that can be made by management and the union itself, they said.

An NLRB spokesman said the UAW will have seven days to provide evidence. An NLRB regional director will investigate and a hearing will likely follow. Chattanooga falls under the purview of the board's regional director in Atlanta.

The UAW said in a statement that its appeal details "a coordinated and widely publicized coercive campaign conducted by politicians and outside organizations to deprive Volkswagen workers of their federally protected right to join a union."

The election loss at the plant in Chattanooga was a blow to the UAW, which spent two years trying to convince the workers there to unionize, but still lost, even with the support of VW.

Obama recently got a majority of Democrats appointed to the five-member NLRB, which is historically more pro-union when Democrats hold the White House, and less so when Republicans do.........................Let's hope the RATS don't overturn the elections results.

This goes to Obama's kangaroo court NLRB. Reversal is a lock.

But the Supreme Court is hearing a case challenging Dear Leader's recess appointments to the Board, so this Board may not be the one that would hear the case.

How can anybody intimidate somebody to vote a certain way in a secret ballot? I would think intimidation would be counter productive unless the employee feels that his vote will not truly be secret.

Mr. Bottom put his fellow Commies on the NLRB illegally, using recess appointments while the Senate was still in session. At least these criminal acts are being challenged, if others are not. Any decisions issued by the poofter’s goons will be nullified.

This isn’t going nowhere, and here’s why: TN is a powerhouse of manufacturing and jobs, and it is ranked #1 to retire (better than TX). The state is so red, it bleeds. So if the NRLB does overturn this, TN will tell VW to pound sand.

That’s why the union thugs want card check instead of secret ballots, precisely so they can intimidate workers. See: Steelworkers Local 401 in Philly; members & associates brought up on RICO charges. They beat up independent contractors with baseball bats and even destroyed a Quaker meeting house.

manipulate the vote, if that doesn't work-
demand a recount, if that doesn't work-
find a sympathetic judge and ask for the election to be thrown out.

I do not recognize obama as the presumptive president i want a recount and if that does not work i want another vote. see two can play at this game.

Teacher unions NEVER let people re-affirm (via vote) unionization once it's in power. Some unions have been in power for DECADES and all of the current employees never officially voted to AGREE to that compulsory collectivist institution (method of bargaining/contracting)! Suddenly votes "matter," regular re-votes "matter" to 'make sure' employees have truly rejected [read: want] mob rule.......

I heard the CEO of VW made some idiotic statement regarding this also. Anybody have further info on this?

You are right. They’ll just keep saving the pro union ballots from each election and resubmitting them over and over until they accumulate enough to declare themselves the “winner.”
