Obama Silences Critics With IRS

President Obama is using the Internal Revenue Service to silence employers unhappy about Obamacare. That’s the hidden purpose behind the employer mandate delay announced on February 10th.

The administration released 227 pages of mind-numbing regulations ridiculously billed as making “ the compliance process simpler and easier” for employers. Hidden in the gobbledy-gook (on pages 125-6) is a requirement that employers sign a statement to the IRS, meaning under penalty of perjury, that they have not reduced the number of employees or cut hours to shield themselves from the costs of Obamacare.

Democrats running for re-election this fall are desperate to avoid similar headlines. This time, instead of the president offering employers a delay, he is offering most of them a bribe to keep quiet. Once employers swear that they have not cut hours due to Obamacare, how can they speak out about the law’s harm to their business?

The new rule criminalizes something Congress has not made a crime, and federal courts have said businesses can do. Federal court judge Learned Hand observed in 1934 (Helvering v. Gregory dicta) that “Any one may so arrange his affairs that his taxes shall be as low as possible; he is not bound to choose that pattern which will best pay the Treasury; there is not even a patriotic duty to increase one’s taxes.”

Deceit is the primary motive behind the newly announced regulation. On page 36, it states that although employers are distressed that the law defines 30 hours as full time job requiring insurance, nothing can be done because the statute expressly states 30 hours. What—this is the only part of the statute the administration won’t change by fiat?

What does having such a regulation due in furtherance of the collection of taxes besides trying to keep dems in office? NOTHING. IMO it is not enforceable.

I don’t see how the federal government can possibly say that it has any legal right to do this. Somebody affected by it should challenge it.

The IRS has always been a club for corrupt presidents. Its a powerful weapon and in the wrong hands can be deadly.
Obama and his goons love to use this, the NSA and the FBI. The lawless don’t need to worry.

Lying under oath is enforceable though. Basically they have you swear that under oath that you’re not laying people off because of ObamaCare. Companies will agree to this for a waiver of paying a penalty next year.

Then, when they do lay someone off, they can’t mention it to FoxNew or anywhere.

I am not in a position to violate it but simply disregarding it would result in what, some enforcement action to comply which has no basis in law? IRS used to “regulate” tax preparers. Preparers refused to comply, the IRS sued and lost in every circuit. Just because the government says it is so, does not make it so unless there is a basis in law they do or require something.

I do agree, that filing a false statement will result in your prosecution regardless of the legitimacy of the reg.

No document signed under duress has legal validity.

No rational person would say that agreeing to surrender one’s First Amendment Rights while under the threat of having everything you own seized was anything but duress.

The courts would cheerfully enforce it though. (Lawyers and judges have assets too!)

Good luck even hiring a lawyer when the IRS has confiscated every dime you have, padlocked your business, and is holding every asset pending the outcome of your IRS trial, in IRS court, with an IRS judge...

First action of the Repub President is by precident set by Barry is to abollish the IRS by executive order. Ridding the country of the IRS would ne a great step towards freedom.

Anyone could be subjected to one of the insidious TCMP audits for any reason at any time nonetheless.

So, the question is, what to do about it, let them stiffle commentary like they tried and are trying with the FCC or standing up for ones rights. Of course no one is going to take this on, so I am also pointing out by inference what happens when individuals sit idlely by and let this monsterous government roll over our individual right to be free from government interference in our lives.
