Andrew Henderson, a Little Canada man criminally charged after he videotaped activities of a sheriff's deputy and ambulance crew, said he could have settled the case by pleading guilty to a petty misdemeanor and paying a $50 fine. But Henderson, 29, rejected a prosecution offer and insisted on a jury trial, which began Wednesday morning in Ramsey County District Court. Four lawyers were in attendance plus a handful of spectators interested in civil liberties issues.

What videotaping?

There’s no evidence he was videotaping...the cops erased it.

I bet if the actual video had shown Henderson getting in the way of the paramedics copies would have been made and used at the trial. Exculpatory evidence gets deleted.

If you want to video the cops, you have to have a whole team doing it to get multiple copies and to video members of the team being harassed by the cops. It also helps to have a camera which can automatically upload the video to the web as it is being made.

Even if they didn't "erase it", it is obvious that they took no steps to preserve evidence which they justified seizing. Somebody needs to explain how their police procedures permit this incompetence.

Have they no policy concerning the preservation of video evidence seized from defendants? They certainly can't claim that they seized the camera because possession of a camera is prohibited; the existence of the video is the only "justification" for the seizure.
