Feds give 2-year grace period for non-Obamacare plans [and a special, illegal exemption for unions]

The Obama administration will let people with health insurance plans that don't comply with Affordable Care Act standards keep them through October 2017 if their states allow it, officials said Wednesday in announcing a series of final Obamacare rules.

New rules also simplified the paperwork that larger employers will have to file when the the mandate obliging them to offer affordable health insurance to workers begins next year.

And the rules gave a financial break to the types of self-insured health plans run by many unions, excluding them for two years from the $63-per-capita "reinsurance contribution" assessed for each enrollee.

Under the new rule, people who maintain those plans, and who renew them as late as Oct. 1, 2016, will be able to keep them until as late as 2017. The administration Wednesday emphasized that the extension now includes people in the small-group market, whose employers will start becoming subject to Obamacare's mandates in 2015. The administration said it would be up to individual states to allow the extension, and whether to include both individuals and small group members in the waiver or just one category.

The extension could give political relief to Democrats, particularly in vulnerable legislative districts, who face criticism about the effects of Obamacare on their constituents. It also effectively delays until after the 2016 presidential election the requirement that nearly all Americans have health insurance that complies with ACA minimum standards. Most people who do not have health insurance by this year face a tax penalty in 2015 equal to up to 1 percent of their adjusted gross income.

There will be no final rules—Sebelius has the power to do as she pleases until she gets a permanent dirt nap.

The worst part is, hardly anyone in America gives a s__t. The Dems love it because they want the law to remain in effect in a way that doesn’t hurt them. The vast bulk of America won’t pay attention until they are told to fork over a couple thousand dollars more, which will happen after the law is safely in place. And the media will scream “Racism” or ignore any conservative who points out that Obama is acting like a dictator in passing laws that Congress should be voting on.

The good part is, however, that Obama has set a precedent. So if a Republican gets elected in 2016, he/she can extend the compliance extension to the year 3016.

Maybe, but the taxes, fees, and compliance structures will remain in place. For the sake of the children.

All the changes are illegal AND all the changes help Democrats fool people through anther election cycle...

What about the formerly insured that have already been screwed out of their old plans? Tough luck suckers?

That’s what I want to know. We only got a 3 month extension. Our original plans are GONE. There is no “option” to keep it for two more years.

Can we go out and buy one of those “old non-compliant plans” for the next two years? Apparently not.

I’m not whining as I have already made my decisions but the obvious question is how in any universe it is legal or fair to say “tough luck” to those who already lost good affordable plans and “lucky you” to those who somehow have not been cancelled yet and they get to keep “non-compliant” plans for TWO MORE YEARS... presumably at the rates they have been paying? How is that going to work? Are the insurance companies going to be allowed to change the prices on those old plans? How do they determine how much to charge for those old plans this year and then next year?

This is madness. (ignoring the 300 movie reference, it really IS madness.)
