The Daily Caller reports Senate Democrats sent a letter to the Health and Human Services (HHS) Department askingfor a reprieve from ObamaCarefor small businesses scheduled to be brought under its regulatory umbrella in 2016. Apparently, the group fearsit will be particularly harmful and disruptive to businesses. The Callerreports that the letter was sent March 12 by Democrat Senators Claire McCaskill,Heidi Heitkamp, Chris Coons, Joe Manchin, Joe Donnelly and Jon Tester, and independent Sen. Angus King. They asked for a two-yeardeferment: Under the law, employers with 51 to 100 employees will be included in the ACAs definition of small group market starting...

As WSJ reports, last week's geopolitical chaos and distraction was ideal for a news dump, and the White House didn't disappoint: On no legal basis, all 4.5 million residents of the five U.S. territories were quietly released from ObamaCare. It seems the costs of healthcare soared in these five territories due to uneconomic mandates - which woul dhave been a disaster PR-wise for the administration and so, under cover of catastrophe, WSJ reports all of a sudden last week HHS discovered new powers after "a careful review of this situation and the relevant statutory language," that enabled them to 'selectively...

March 12, 2014 4:35 PM Sebelius Won't Promise No More Obamacare Delays By Josh Encinias There are 37 changes to the law, Republican representative Dave Reichert said today at a House Ways and Means Committee hearing, noting that HHS secretary Kathleen Sebelius had promised the American people during a Fox News appearance there would be no more changes to the law. Can you make a promise to the American people that there will be no more delays to the so-called Affordable Care Act? Reichert asked the secretary. Sebelius responded, We will continue to put out regulations to the policies as...

Yes, it appears that President Obama is gearing up to twist Obamacare like Gumby yet again. Fox News reports: The latest delay, expected to be announced as early as next week, would allow insurers to continue selling insurance plans that would otherwise be banned under the law. Fox News has confirmed the extension, first reported by The Hill. It is unclear how long the extension will be, though one unidentified source told the Hill it could last to the end of Obama's second term, and possibly beyond. The extension would ease pressure on Democratic candidates in the midterm elections by...

The Obama administration will let people with health insurance plans that don't comply with Affordable Care Act standards keep them through October 2017 if their states allow it, officials said Wednesday in announcing a series of final Obamacare rules. New rules also simplified the paperwork that larger employers will have to file when the the mandate obliging them to offer affordable health insurance to workers begins next year. And the rules gave a financial break to the types of self-insured health plans run by many unions, excluding them for two years from the $63-per-capita "reinsurance contribution" assessed for each enrollee....

This is either a glaring admission of defeat from the White House or no, thats really all it could be. After weeks of defending the cancellation of health plans insurers discontinued in 2013 in order to comply with the Affordable Care Acts coverage mandates, the White House announced in November of last year that it was urging insurers to reinstate those plans. The catch was, of course, that most insurers would be unable to turn on a dime and reinstate those plans. Furthermore, the administration allowed individual states leeway to determine whether or not they would even allow insurers to...

It takes some doing to get embroiled in a court fight with nuns who provide hospice care for the indigent. Amazingly, the Obama administration has managed it.Its legal battle with the Little Sisters of the Poor is the logical consequence of Obamacares conscience-trampling contraception mandate. The requirement went into effect January 1, but Supreme Court Justice Sonia Sotomayor issued a New Years Eve injunction against enforcing it on the Little Sisters. They are Catholic nuns who follow the doctrinal teachings of the church and therefore oppose contraceptive and abortive drugs and sterilization, all of which Obamacare mandates that employers cover...

Weeks after denying labors request to give union members access to health-law subsidies, the Obama administration is signaling it intends to exempt some union plans from one of the laws substantial taxes. Buried in rules issued last week is the disclosure that the administration will propose exempting certain self-insured, self-administered plans from the laws temporary reinsurance fee in 2015 and 2016. Thats a description that applies to many Taft-Hartley union plans acting as their own insurance company and claims processor, said Edward Fensholt, a senior vice president at Lockton Cos., a large insurance broker. Obamacare, officially known as the Affordable Care Act, was written with explicit language that it was to include everyone. No exceptions. Even members of Congress and their staff were mandated to follow the same rules as every other American citizen. This was apparently done to appease the Republicans and get their support for the bill. Then just before the 2012 elections several unions who had endorsed and campaigned for Barack Hussein Obama began to receive exemptions from the mandatory requirements. Then it was disclosed that members of Congress were concerned that their highly paid staff members would be persuaded to...

Get ready for more, writes Margot Sanger-Katz at National Journal, because the employer mandate is far from the only piece of ObamaCare that’s not ready for prime time. In fact, it might be easier to select the few components that might be ready for the implementation target date than to number those that won’t: If you’ve been reading all the Obamacare stories lately, you might get the impression that the administration has just realized it will not be able to implement the massive health reform as...

Among the objections to ObamaCare, one that has not gotten as much attention as it should is the president's power to waive the law for any company, union or other enterprise he chooses. The 14th Amendment to the Constitution provides for "equal protection of the laws" for all Americans. To have a law that can cost an organization millions of dollars a year either apply or not apply, depending on the whim or political interest of the President of the United States, is to make a mockery of the rule of law. How secure is any freedom when there is...

The Obama administration granted more than 1600 waivers over compliance with parts of the Patient Protection Affordable Care Act. The Supreme Court ruling that the individual mandate is a tax will not affect the waivers, as they dealt with what kind of insurance people have, not whether they have it. The ruling, and the waivers, point us directly to the disaster that awaits the country unless the PPACA is fully repealed. (snip) What happens on January 1, 2014? You know Kathleen Sebelius well. She's Secretary of Health and Human Services, which, among other things, makes her in charge of implementing Obamacare. You'd think she'd know the law inside and out, and that she'd be able to at least semi-coherently answer questions about it at a Senate hearing. But when Sen. The most damning exchange occurs when he asks her about healthcare waivers, which would exempt certain employers from having...

Roughly 1,200 companies received waivers from part of the healthcare reform law, the Health and Human Services Department said Friday. Friday marks the last time HHS will have to update the total number of waivers, putting to rest a recurring political firestorm. The department had been updating its waiver totals every month, prompting monthly attacks from the GOP. Republicans say the need for waivers proves that the healthcare law is unworkable. In a column about the revolving door between big government and the lobbying world, heres what the irreplaceable Tim Carney wrote about the waiver process for folks trying to escape the burden of government-run healthcare. Congress imposes mandates on other entities, but gives bureaucrats the power to waive those mandates. To get such a waiver, you hire the people who used to administer or who helped craft the policies. So whos the net winner? HHS: Pelosi had no influence on healthcare waivers to her district By Mike Lillis and Julian Pecquet - 05/17/11 02:53 PM ET House Minority Leader Nancy Pelosi (D-Calif.) had no influence on the healthcare waivers granted last month to businesses in her district, an official with the Department of Health and Human Services (HHS) said Tuesday. Republican leaders on and off Capitol Hill had slammed the Obama administration for granting a growing number of health-reform waivers to constituents of the top House Democrat. But Steve Larsen, director of HHS Center for Consumer Information and Insurance Oversight, said those businesses were...

The president cannot simply decide who does and does not have to follow the law... The constitutional dispute over the health-care law has thus far centered on the lawfulness of the statute itself most dramatically when, last week in Florida, a federal judge held the act to be void. Waiting in the wings, however, is another constitutional question, one concerning not the statute, but waivers from it.

Yesterday, the Deparment of Health and Human Services announced it had granted more than 500 new waivers to Obamacare's requirement that health plans have annual limits of no less than $750,000. This annual limit requirement climbs to $1.25 million next year and then to $2 million. The reason these exemptions from the law are needed is that Obamacare forces all health insurance consumers to over-insure themselves and pay high premiums as a result. Without the waivers, many companies, non-profits and unions would simply drop their health plans.

The Hot Air Boss Emeritus has published an updated list of the exploding number of groups and businesses being granted waivers from having to participate in Obamacare. This is one of the more under-reported stories of the entire HCR saga in the mainstream media, in my opinion. In early October, the Obama administration announced it had granted waivers not only to McDonalds, but also to several other firms and labor unions. Now comes word that Torquemada HHS Secretay Kathleen Sebelius has approved a whopping 111 waivers for businesses of all sizes, along with more unions and other providers of health...
