A Massachusetts judge ruled Tuesday that the Connecticut teen in the middle of a contentious custody battle between her parents and the state will remain in the custody of the Massachusetts Department of Children and Families.
The Boston Globe reported that Suffolk County juvenile court Judge Joseph Johnson granted permanent custody to the state DCF, leaving it up to the agency to decide if and when 15-year-old Justina Pelletier is returned to her parents custody. This decision was in response to a motion filed by Linda and Lou Pelletier, Justinas parents, and her court-lawyer attorney for a conditional custody plan.
Mat Staver, attorney and founder and chairman of Liberty Counsel, told TheBlaze as he understands the order that was filed with the clerk Tuesday afternoon, the DCF will retain custody of Justina until May 25 at which point another hearing will be held.

According to the Howie Carr show this afternoon the state was ordered to re-start her medication but the state has refused. The child has been deprived of medication, education and religious support for a year!!! The family is Catholic and she is not allowed to have religious services. She is being held against her will and against the family's will.
BTW there are four or five other recent cases where families have brought their child to Children's Hospital in Boston and they have lost custody of their children. ALL of those cases involved parents from out of state. There is a 40M lawsuit pending from a European family that lost custody.
The poor kid could well die because her disease is not being treated. Should that happen,I hope the parents sue the hell out of the doctors who misdiagnosed her and Boston Children’s Hospital for malpractice.
The Judge was chosen based upon who nominated him
so that the child would remain a prisoner of the State,

It is only a matter of time before somebody who loses their loved one like this ends up taking note of the names and addresses of said "authorities" and takes his own revenge in his own sweet time. The "authorities" and their "courts" won't be involved until they finally catch him - unless he catches them first.

BOSTON GLOBE: The judge made his order retroactive to late December, so a review could occur as soon as early summer.
So now with one sweeping decision all that has come to light recently, all that happened while the State had custody...boy thats convenient -retroactively. This all reeks of CYA, this judge is a coward.

What’s going on here; how often does this happen? I mean, is everyone in danger of losing their children when they disagree with a medic’s opinion/treatment/diagnosis?

Not that I am aware of and I've followed this story fairly well. Apparently this hospital has done this with other out of state children before according to another poster. Not sure if it was said on this thread or the other one.

Class action lawsuit sounds about right to me. Other solutions I am thinking of are probably best left unsaid.
The psychologist assigned to the case has a research program somatoform disorder and written four papers on somatoform disorder. In one paper she postulates that as much as 50% pediatric illness is somatoform disorder, in other words they are faked symptoms/disorders.

I watched it from the start and it is worth it to get the whole picture. The video is 44 minutes but the Pelletier story only goes to 33 minutes.

Abstract
Purpose of review: Due to the increased prevalence of psychosomatic presentations and the difficulty of managing such patients, this article summarizes the latest findings for identifying individual and family risk factors, and new trends in the evaluation and management of pediatric patients with psychosomatic illness.
Recent findings: Up to 50% of patients in pediatric care will complain of medically unexplained symptoms with significant functional and emotional impairment. Such patients place heavy burdens on the healthcare system (frequent utilization of health resources and hospitalizations, specialist consultations, unnecessary investigations, and treatments). Somatoform disorders in pediatric care are associated with risks for psychiatric co-morbidity (anxiety and depressive disorders), family conflict, parent-perceived ill health, and school problems/absenteeism.
Summary: Gaining expertise in addressing pediatric psychosomatic illness can make a great difference in patients life and in physicians professional satisfaction. Effective treatment approaches involve a multidisciplinary approach to consolidate care and facilitate communication, target the patient/family’s understanding of the mindbody relationship and their acceptance of the bio-psycho-social formulation and treatment, and utilize functional rehabilitation and cognitive behavioral therapy for the individual and family and management guidance for schools.
