Judge Rules Justina Pelletier to Remain in State’s Custody

A Massachusetts judge ruled Tuesday that the Connecticut teen in the middle of a contentious custody battle between her parents and the state will remain in the custody of the Massachusetts Department of Children and Families.

The Boston Globe reported that Suffolk County juvenile court Judge Joseph Johnson granted “permanent” custody to the state DCF, leaving it up to the agency to decide if and when 15-year-old Justina Pelletier is returned to her parents’ custody. This decision was in response to a motion filed by Linda and Lou Pelletier, Justina’s parents, and her court-lawyer attorney for a “conditional custody” plan.

Mat Staver, attorney and founder and chairman of Liberty Counsel, told TheBlaze as he understands the order that was filed with the clerk Tuesday afternoon, the DCF will retain custody of Justina until May 25 at which point another hearing will be held.

I would have sworn that there was a story a week or so ago about her being returned to her family. This is just getting more and more confusing.

This judge’s “decision” is, in essence, a NON-DECISION. The judge is every-bit as evil as the State and medical torturers of this young girl.

Her case is a cautionary tale of what happens when the state has too much power over your children.

Sad to say, I think she will end up Dying in state custody because the state needs he to die in order for them to cover state incompetence.

Per the above article, she’s being treated at the medical facility of the family’s choice.

But she’s not in her family’s custody.

IIRC, one of the other children has the same condition (or was it their mom; I forget).

And she’s away from the facility where they said it was “all in her head”....

The legislators are aware of it and hopefully they can curtail the power of these intrusive (insert bad language here) psych department people.

A big question I have is:

How can a psychiatric condition cause somebody to go from ice skating to being in a wheelchair ?

A long-running child custody case took a dramatic turn Tuesday, when a Massachusetts juvenile court judge awarded “permanent” custody of teen-ager Justina Pelletier to the state Department of Children and Families. The ruling by Judge Joseph Johnston leaves it up to the agency, not the court, to decide whether or when Pelletier should be returned to her West Hartford, Conn., home.

This person said the state, which has had temporary custody of Pelletier for more than a year, has no immediate plans to have the 15-year-old sent back home, or to a facility in her home state.

Pelletier is at a residential facility in Framingham, Wayside Youth and Family Support Network, and it remains unclear whether or when the state child-protection agency will act on its stated efforts to get the girl back to her home state. Its previous efforts to try to find a residential treatment center for her in Connecticut have failed, largely due to the reluctance of many providers to get involved in a

high-profile controversy.

Mahoney, the parents’ spokesman, said they are questioning why their daughter has yet to be seen by physicians at Tufts, including her long-time metabolism specialist, Dr. Mark Korson, despite the state’s stated wish earlier this month to transfer the girl’s primary medical care from Children’s to Tufts.

She has not been returned to Tufts and hasn't been seen by any doctor from Tufts.

I also thought she had been returned to her parents and couldn’t believe this judge ruling this way. I tuned into Howie Carr (via computer) and he had a state legislator on talking about the case.

I’m wondering why Connecticut is doing nothing. I guess they’re busy trying to confiscate guns.
