The Montana Supreme Court on Wednesday overturned a one-month sentence that was widely condemned as too lenient for a former high school teacher convicted of raping a 14-year-old student.

The court ordered a new judge to re-sentence defendant Stacey Dean Rambold, who has been free since completing the previous term last fall.

Yellowstone County Attorney Scott Twito said that according to state sentencing laws, the decision means Rambold must serve a minimum of two years in prison.

The high court's decision cited in part the actions of District Judge G. Todd Baugh, of Billings, who suggested the young victim shared responsibility for her rape because she had some control over the situation.

Rambold's attorney, Jay Lansing, was traveling and not immediately available, his office said.

State prosecutors said Rambold should have received a minimum of two years under state law.

I guess I'm okay with that for the judge, now how many years does the POS rapist get?

I think the judge should get 2 years, the perp should get much worse

They both deserve death. What I’m saying is that as small as 2 years is, it’s time enough for some real retribution to take place behind bars. My understanding is child rapists don’t do well in prison.

Baugh also made comments pinning some of the responsibility in the case on Moralez, whom the judge described as "older than her chronological age."

I don't care if the girl had screwed 100 guys and had the ability of Hoover vacuum. She was a minor and legally couldn't give consent. Even more to the point no matter how she [may have] come on to this man, he is the adult, the teacher and he should have the moral fortitude to walk away.

For the few years my daughter was in public HS I dealt with teachers and administrators that had a similar code of moral relativity (not necessarily sexual). And I wanted to beat the holy crap out of every one of them. Worthless oxygen wasters, every one of them.

Still burns me 16 years later to think about the ignorant, amoral turds running the school system with which I came in contact.

Someone should be serving life. The should share the sentence.
