Virginia proposal would limit size of gatherings at private homes

A plan to ban "frequent and large gatherings at neighborhood homes" is a lawsuit waiting to happen, a Fairfax County supervisor predicts.

Officials will get an idea Wednesday when public-comment hearings begin in Virginia's most populous county.

"I believe the county is risking a lawsuit and/or a Constitution challenge by interfering with peoples' right to assemble," Supervisor Pat Herrity said in a statement.

I was thinking similar thoughts…next, they’ll limit the size of our homes.

Which is exactly why the size of government should be limited.

They already limit occupancy in areas...not counting illegals.

The idiots who make the laws don’t bother to read the Constitution.

"frequent and large gatherings at neighborhood homes"

How about if they're all heavily armed - does that count?

I remember a science fiction story back in the 1970s; one of the items was that each little cubicle that served as an apartment had a monitor on the ventilation control. If you wanted to have a gathering, you would either have to deal with stuffy air, or increasing the air flow would tip off the authorities that you were having an “illegal” gathering of more than four people.

The sci fi writers certainly were a prescient lot.

Church small groups would be banned as well as other assemblies.

Wonder if having this in place last December would have made the Mount Vernon (Virginia!) meeting, held on Jefferson's estate, for the Convention of States illegal.

I think know what this is aimed at. It’s not the huge estates or old plantations anyone is concerned about. Fairfax County is mostly townhomes and 1/4 acre lots these days. Let’s just say this ordinance has more to do with lovers of HipHop music and assemblies of that nature, and little or nothing to do with scout meetings Tupperware parties and the like.

There are plenty of Noise ordinances and behavior laws. This has to be some stupid idiot like Blasio strutting his stuff.

My sons live in Falls Church.

There are already tools in place to deal with such assemblies including noise and parking ordinances. The truth is dealing with these parties is low on the cop's priority list. Passing laws against assemblies will not cuase them to deal with these parties but if the fines are lucrative enough I can assure you they will make it to the scout meetings and tupperware parties. Even more dangerous is when their masters command it they will be at your church or political gatherings.

If the ordinance passes, regulations follow.... Date of meeting, nature of meeting, time of meeting, how many people will be attending, names and addresses of people attending...

This is clearly an attempt to limit grassroots movements, Bible Studies, homeschools, homechurches.

Next they will be telling these gatherings who can attend and what the race makeup must be,

So many Afro American, so many Latinos, so many Gays, so many Lesbians, so many Islamics an so on.

“Church small groups would be banned as well as other assemblies.”

Funny you should mention that; friends of mine lived across the street from a guy who basically ran a church from his home (in a residential neighborhood). It was obnoxious to have so many cars parked and double-parked all over the street, and nobody wants that mass of strangers wandering around their neighborhood (sometimes after dark). The guy eventually sold the home, but I would have had no problem if the town had stepped in and put an end to that nonsense.

Some state parks where I hike want you to get a permit if you have a group of 15 or more; I have no problem with that, considering what it does to the limited parking spaces available.

If these things weren’t impacting other people, I’d support telling the government to step off - but they do impact others. If they didn’t, the government would never know you’re in violation anyway.

I read that some city was able to stop a couple from having a small (ca. 10 ppl.) Bible study at their home because of a law like this

I couldn’t imagine that 10 people could cause that much of a problem; if they called it a family gathering what would have happened. I think zoning is a big issue in determining these things; a neighborhood zoned for single family homes (with parking to reflect that) can’t be expected to accomodate religious services for 50 people several times a week.
