ATF quietly laying groundwork to expand multiple rifle sales reporting

A little noticed and virtually unreported April 15 notice posted in the Federal Register suggests the Bureau of Alcohol, Tobacco Firearms and Explosives intends expanding the multiple rifle sale requirement currently imposed on four border states (Arizona, California, New Mexico and Texas) to all states.

Titled “Agency Information Collection Activities; Proposed eCollection eComments Requested; Report of Multiple Sale or Other Disposition of Certain Rifles,” and assigned OMB Number 1140–0100, the 60-day notice abstract declares “The purpose of this information collection is to require Federal Firearms Licensees to report multiple sales or other dispositions whenever the licensee sells or otherwise disposes of two or more rifles within any five consecutive business days with the following characteristics: (a) Semi automatic; (b) a caliber greater than .22; and (c) the ability to accept a detachable magazine.

“Comments are encouraged and will be accepted for 60 days until June 16, 2014,” the notice advises. That means much of the comment period has already passed with most unaware it ever began. And the ATF website offers no additional information other than links to the notice and to various forms.

The question now becomes, especially with a seeming total lack of publicity, is ATF attempting an “under the radar” action to impose on the entire country what they previously imposed (over objections that could have been stronger) on southwest gun buyers and sellers?

“Now that ATF is saying straw purchasers are altering their behavior, expect that to be used as justification to expand this requirement to all the states,”.

For them to win in court, the court would have to strike down FOPA 86. ATF better ask real hard if that is what they want. Actions have consequences....

I wonder if it would be illegal to set up a "trust" or somesuch and have a single purchaser for [huge] quantities of rifles — a purchase of five thousand rifles by "Col. John Doe; Purchasing Officer, Militia of [STATE NAME]" might be hard to track… especially if we do things in the traditional American way: centralized stores of arms and munitions (i.e. public armories).

They cannot do this without repealing FOPA 1986. This action is specifically prohibited by Federal Law!

If the Fourth Amendment does not constrain the NSA, why should lesser law constrain the BATFE?

ATF better ask real hard if that is what they want.

Oh, they want it — they want it bad.
They [the FedGov] have been mapping social connections for a reason: intel, against the American people.

Actions have consequences....

True — the question really is what the consequences of this would be. I suspect that they're trying for a gentle touch, laying the framework and then [trying to] silently repeal FOPA-86 rather than just out-and-out ignoring it… however, given the great success by the NSA in operating secretly and contrary to the fourth amendment [and arguably the 5th and 6th] they could also simply quietly ignore the law until it is far too late to matter.

I actually suspect that the ACA [ObamaCare] will figure into this: what they can do is have violations thereof be[come] felonies through [perhaps] tax-evasion laws… a waiver form could then be presented to patients which essentially admits to these 'accidental'/'purely technical' felonies and waives the right to trial. — In this manner huge segments of the general population could be put into the "prohibited person" class, meaning that possession of firearms and/or ammunition is an actionable offense; this would provide legal cover for police breaking-in and arresting [or perhaps SWAT-ing] the more outspoken/influential of the group.
