California bill proposed 'gun violence restraining order'

In the wake of the killings in Santa Barbara, some state lawmakers want a way people can report someone who is a threat for violence, with a process then to temporarily remove guns from that person.

One of the authors of a bill says current mental health laws and gun control laws aren't working together.

"I think we should always take a prudent review of our laws at a time like this," interim Kern County Mental Health Director Bill Walker told Eyewitness News.

But, he said with this issue, laws have to address both public safety and individual rights.

State Assemblymembers Nancy Skinner, D-Berkeley, and Das Williams, D-Santa Barbara, announced the proposal Tuesday.

"The proposed legislation would create a gun violence restraining order, establishing a system where concerned family members, intimate partners or friends can notify law enforcement of someone who is demonstrating a propensity to commit violence toward themselves or others," reads a statement on the websites for both lawmakers.

The legislators say when family members would notify law enforcement, there would be a tool to "potentially prohibit the purchase of firearms and/or remove the firearms already in possession."

The statement says authorities could investigate the threats and ask a judge to grant an order banning gun purchase or possession.

Walker said the idea should be seriously considered and debated, but he has concerns.

Bakersfield attorney Loren Kleier also has doubts.

"It's unnecessary," Kleier said. "We have plenty of statues already on the books that are in place."

He points to the "51-50" hold that trained professionals can order for someone with mental issues, and he said that has a function to remove guns.

One of his client's guns were taken after the man's girlfriend called law enforcement about his irrational behavior.

I lived in Ventura county, and these 'necks came out from San Fernando valley. SF valley was notorious for being populated by Dust Bowl refugees and became somewhat of a ghetto for them before Mexicans took over.

The husband was a LA county deputy sheriff on full-pay "disability" retirement with "bad back" that was so bad that he went water skiing every few months. Total fake scam and I let him know I knew it.

I know what your sensitivity might be, but it is misplaced. Having party animals living next door to you that do not give a damn that you have to get up and go to work in the morning, because it might interrupt their party and wife swapping?

That is not being a good old boy, that is being an inconsiderate piece of white trash.

The POS had the gall to come into the court and tell the "so-called" judge that because I was a Marine veteran, he was afraid of me going berserk and using that to cement his argument for the TRO.

Well, he was right about something.............

Oh, I like this! Let me be the first...
I would like to get a gun restraining order against the bodyguards of Diane Feinstein, Barbara Boxer, Nancy Pelosi. and Jerry Brown. (And all future bodyguards) Obviously all of those bodyguards have a few screws loose or they would be able to go out and find a way to earn an honest living.

I’m ex infantry, I had two airforce guys try that argument on the MPs. They basically provoked me into telling them if they didn’t cut out their juvenile behavior, we could take a walk into the low ground.

They said because I was ex-infantry they were afraid for their lives...lol. The MP rolled his eyes at them and told them if they spoke to him the way they spoke to me, he’d take them to the low ground too lol.

Will this keep cops from shooting dogs?

This is California, our police moved on to shooting kids carrying airsoft rifles, little Asian ladies delivering papers in pick up trucks, homeless vets, and drunks holding hose nozzles.

On the plus side, the California Supreme Court has verified that a police department can keep the names of these shooters secret, if they can come up with a good enough reason. Err, the plus side being that this changes it from 'because we don't want to tell you.'

Hmmm. How about a “fascism and collectivism restraining order”? Every time a politician proposes a law increasing goobermint power at the peoples’ expense or goes an entire year without proposing a bill repealing one of the old laws, he’s placed under house arrest and prohibited from voting in the legislature for 90 days?
