It’s a violation of 8 U.S. Code § 1325 - Improper entry by alien.
First time’s a Federal misdemeanor, up to 6 months jail AND/OR a fine of $50-$250. That’s where they get the “it’s a civil infraction” bit.
Not like some Mexican Invasion Reconquistador AHole would get that.
A shipload of Chinese landed at Ensenada, Mexico about 20 years ago. I remember that the Mexicans rounded them up, painted their heads red, and put them all on a plane bound for China. The Mexicans know how to enforce THEIR immigration laws.
