Speaking to reporters on Wednesday, House Speaker John Boehner announced he will be filing a lawsuit in the coming days against the White House in an effort to stop President Obama's continuing executive overreach.
"This is not about impeachment -- it's about him faithfully executing the laws of this country," Boehner said during the announcement.

The lawsuit could set up a significant test of constitutional checks and balances, with the legislative branch suing the executive branch for ignoring its mandates, and the judiciary branch deciding the outcome.
Boehner told the House Republican Conference during a closed-door meeting Tuesday morning that he has been consulting with legal scholars and plans to unveil his next steps this week or next, according to sources in the room.
Boehner spokesman Michael Steel said further action is necessary because the Senate has not taken up bills passed by the House targeting executive actions. The House has passed a bill expediting court consideration of House resolutions starting lawsuits targeting executive overreach and another mandating that the attorney general notify Congress when the administration decides to take executive action outside of what has been authorized by Congress.

Betting this is as far as it gets. I mean, it’s a headline and no action. If he were serious, he’d go for impeachment!
Boehner always talks big when he is drunk (and that is most of the time) BUT there is a fine line between Boehner attempting to sound fierce, and Boehner crying like the drunken slob he is!

The courts will kick it back, saying the legislative branch only has the impeachment option per the Constitution. (And they would be correct in doing so.) He knows this is what’s going to happen; when it gets kicked back to him, he will then claim something on the order of, “Well, we’re not happy but it doesn’t rise to the level of impeachment so we’re not going to do anything.” He believes this will defang the conservative demands that he do something.
In other words, he knows this is all for show and it won’t go anywhere.

Boehner is suing the WH because he doesn’t have the support of Reid to remove Obama from office even if HoR impeached Obama. In other words, Clinton proved that impeachment by the HoR is meaningless without the support of the Senate.
But if patriots and former Obama supporters would exercise their voting muscle in 2014 and elect senators who would be willing to follow through with a House impeachment and remove Obama, then things may get interesting.
It would be better to use bthe power of the purse to force compliance with the law, rather than to beg the courts to save them.

Posturing. If I was 0bama I would call his bluff. Then I would get a divorce.......
Maybe so, but it may also be a case of first impression that the Supremes will then need to figger out. We all know impeachment is a bust, so why not sue and see what happens. Better than sitting on hands like the pubes are doing now.
This is a fools errand, and may end up making the GOP look not only foolish, but impotent. The House has no standing to sue the chief executive because he is recalcitrant at enforcing the law. The Supremes will say that is what elections are for. We are royally screwed.
Obama has no respect for the rule of law. If, IF, he had standing and IF he won the case, who will enforce the judgement...Obama? We have watched obama give the codified law the middle finger for the past 6 years. He would just do the same here. Impeach Holder, Koskinin, the EPA chief and anyone else who is below obama. Defund obamas favorite pet projects. But sue??????? Meant to take our minds off of what they did to McDaniels. Let us not forget.
Not necessarily so. An older Supreme Court case holds that a legislative body (state legislature) has standing to sue the chief executive (governor) for failing to enforce duly enacted laws because that refusal has the effect of completely nullifying the votes of all the legislators (i.e., how the legislature voted becomes irrelevant). That case is Coleman v. Miller, 307 U.S. 433 (1939). Coleman was discussed by the Court in Raines v. Byrd, 521 U.S. 811 (1997), a case in which 6 members of Congress sued to prevent Clinton from exercising the line item veto Congress had recently enacted, and was accepted as granting standing to a legislature where the executive’s actions have the effect of “completely nullifying” the acts of the legislature.
That is what Obuttocks is doing here, at least that is what we’re claiming he’s doing - nullifying the vote of the entire Congress by completely ignoring the laws duly passed and signed into law by prior presidents. That should give the House standing under Coleman.
