Boehner to Seek Bill to Sue Obama Over Executive Actions

WASHINGTON — Speaker John A. Boehner announced Wednesday that he would introduce legislation next month allowing the House to sue President Obama over his use of executive actions.

In a letter to lawmakers, Mr. Boehner expressed concern with what he — and many in the Republican conference — considered the president’s unconstitutional overreach.

“The Constitution makes it clear that a president’s job is to faithfully execute the laws; in my view, the president has not faithfully executed the laws,” Mr. Boehner told reporters. “And when there’s conflicts like this between the legislative branch and the administrative branch it’s, in my view, our responsibility to stand up for this institution in which we serve.”

Representative Nancy Pelosi of California, the Democratic leader, called Mr. Boehner’s move “subterfuge,” and Josh Earnest, the White House press secretary, said that “it seems that Republicans have shifted their opposition into a higher gear.”

“Frankly, it’s a gear that I didn’t know previously existed,” Mr. Earnest said. “The fact that they are considering a taxpayer-funded lawsuit against the president of the United States for doing his job, I think, is the kind of step that most Americans wouldn’t support.”

You’re not getting the time frame thing Star. Obama will be gone long before the courts are done with this. That is why it is a waste of time. If Republicans were serious they would defund any law that Obama creates or destroys but they are not serious people. Sad but true. At any rate I can live with our difference of opinion here. No biggie.

If you look over other Constitutional issues in the history of our country, they go through many administrations. We’ve got Constitutional issues going on right now that have gone on for over 50 years!

You always want to get Constitutional issues dealt with as soon as you can and we’ve got one right now with Obama and him stepping on the “Constitutional turf” of the US House of Representatives.

The problem with defunding is that it takes the Senate, too ... and that’s not going to happen.

No, I don't think I have made a mistake.

Legislation is not law w/o both houses concurring. Boehner is seeking the right to sue the President which requires a change in the law affecting the relationship between 2 branches of government.

Constitution, Article 1, section 7:

Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a law, be presented to the President of the United States: If he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it........

I am aware that the decisions have come down but have not heard that any have been followed.

Perhaps I am not paying close enough attention.

I just don’t see where we get out of this mess in one piece.
Our children or grandchildren will likely never see a fraction of the freedom we knew growing up.

They are not passing a law ... they want to have “standing” as a “body” (the body being the US House of Representatives) ... therefore the vote being passed by the House shows that the court case is from “that body” - the US House of Representatives.

Without the weight of law, their “standing” is but their own opinion, worthless in court.

The courts will toss this in about 1-2 years, & by then Obama will have destroyed even more of this nation.

The courts are where you go to get s-l-o-w justice. The purse strings could be cut next budget season, while impeachment could begin the second week of November.

Boehner is a coward, a weak leader motivated by self interest. We need a hero leader who will jump into the water to save this country, not a fool who thinks draining the lake is the most prudent action.

If the US House of Representatives acts as a body, that is standing for them. It’s different if it’s simply a handful of Representatives who jointly decide they are going to file a court case. That “handful” wouldn’t speak for the entire body, you see. That’s what they’re doing here, in order to initiate the case.

As far as “tossing it” ... I’m glad you weren’t advising those in the 12 US Supreme Court cases that slapped down Obama. I’m sure you would have advised them that it was useless and their cases would be “tossed” ... LOL ...

Well, you might be right, I'm not a lawyer nor legislator, but I doubt it.

You may be willing to wait through 1-2 years of court challenges, & we know Boehner knows the Rats will challenge this in court, but the country cannot afford to wait.

Clever legislators often pursue useless goals to pacify annoying constituents, donors, & the public.

There’s always the Constitutional provision of the Impeachment process for removing a President from office, but in saying that ... I can guarantee you it has about 1,000 times less chance of succeeding than this court case that is being proposed.

Neither effort will succeed. I said that in my first post.

A lawsuit will have little effect on Obama. His lawyers will string it out until he is out of office. The MSM will not cover it. Nobody will know or care the outcome. It will business as usual for Obama.

But, impeachment is a serious, personal, public attack. It will hamstring his agenda for months as he vigorously defends himself. It will headline the media for months. It will expose all the Obama criminality as one big conspiracy, unlike the individual scandals that never did. People under the threat of indictment (impeachment) tend to stop that behavior which led to the indictment. Stopping his illegal executive orders is the reason for the lawsuit.

A lawsuit will disappear into the legal system while an impeachment & trial will be front page, every day, for every news organization for MONTHS. Which would you rather subject Obama to? Which is more likely to get Obama's attention?

Mark my words: If the lawsuit gets the go ahead in the House, after a week or so of publicity on FOX only, you will hear little about it in the future, & we will be right where we are today, in serious decline & failing fast. Obama's illegal executive orders will continue until his last day in office.

I'm going to bed. I'll reply tomorrow if necessary.

No it doesn’t. All appropriations bills must originate in the House. If the House does not provide funding for an activity in an appropriations bill , the Senate’s only choices are to vote for the bill, against the bill, or sit on the bill demanding the House add the funding.

The founders were smart people and thought this through. They wanted the branch of Congress accountable to the voters every two years to control appropriations believing the people would be angry at wasteful spending. The unfortunate thing is they could not conceive of a federal government growing to the size where it directly dispense favors from the treasury to individuals and groups to buy votes. They also could not conceive of a secular citizenry rejecting values such as personal accountability and thrift. The people of today are not outraged and demanding the House reign in spending because they are either dependent on it, they can’t conceive of the president acting against the interests of the nation, or they are apathetic.

I’m afraid there aren’t enough people who dare about individual liberty in the population or in Congress. We are beyond the tipping point on culture and values.

Yes, you are absolutely correct. Enter in now, several hundred confidential FBI files found in the Clinton's private residence.

Trent Lott (R-Miss), Senate leader at the time, told Henry Hyde, House leader, “Henry, you're not dumping this $hit on me”, speaking of the articles of impeachment that Hyde dutifully delivered to the senate chamber after the house voted in the affirmative.

It was reported that Senator Trent Lott had once visited a 19 year old gay prostitute, all of which was purported to be contained within....you guessed it, Lott's confidential FBI file.

In many circles, it is believed that Clinton was not convicted by the senate during impeachment because of blackmail. Furthermore, although there was a brief investigation into how these FBI files got into the private residence of the white house, Hillary Clinton was never held accountable for breaking the law.

Corruption, mismanagement, impotence, greed, lust...makes for a great book huh? Problem is, it is our government.

Boehner is a political animal. He knows full well that many will buy into this whole law suit bizz. There is more going on behind the scenes that meets the eye.

Watch the left hand, while everyone else is distracted by the right.

It ain't goin nowhere. Again, dog and pony show.

The most recent ruling against Obama concerning the recess appointments of certain persons to the NLRB was brought byt a Pepsi Cola bottler. It was not brought by Congress.

Congress’ powers and purview are completely different from those of a bottler.

Congress is a law-making body, not a petitioner to a court. The issue of jurisdiction is not even clear unless it is decided that Congress has no business being before a court as a petitioner against the executive brach.

Unfortunately, Obama has this correct, this is indeed a stunt by Boehner. But it’s also very risky because if the court dismisses the case for lack of jurisdiction, then the GOP has egg on their faces going into the 2014 midterms.
