SURPRISE, Ariz. -- An assistant superintendent for the Dysart Unified School District defends calling a kindergartner's actions "sexual misconduct."

Five-year-old Eric Lopez pulled his pants down on the playground at Ashton Ranch Elementary School last Spring and received a punishment of detention for what the school has deemed sexual misconduct.

Eric now has a note that will remain in his permanent file for the duration he attends Dysart schools. His mother was not notified of the incident or the note her son signed in the assistant principal's office until after the fact.

District policy states that a parent does not have to be present for a disciplinary meeting unless the student requests his or her parent.

"He did not know that he could ask for me," said Eric's mother, Erica Martinez "He's 5."

Martinez has been fighting for two months to have the sexual misconduct label removed from her son's file, saying Eric's actions were not sexual in any way. So far, the district has denied her appeal."

This is when I wish I’d gone to law school. Some lawyer and this family will be well-off about two years from now.

The story is slanted in favor of the schrewal. It omits that this "depantsing" was the result of a bullying incident, which the education establishment has chosen to ignore in the interest of ensuring a steady supply of future police officers to keep the canine population under control.

And public schools don’t get why the truly awake parents prefer sending their children to a Charter School. Charter Schools vary in quality, but are easier to negotiate with.

This is the time to get a lawyer and sue.

No child that age cannot legally make any decisions as such. A five year old cannot sign a contract that is binding...heck a child must be 13 to go on kids websites w/out parent supervision

A judge will toss this school decision

You and your staff ought to be completely ashamed and fired. You should not have anything to do with children and are in the wrong field. I see a bright future for you in prison administration. You have badly overreacted with your bullying of this 5 year old boy. Also you have clearly demonstrated you know nothing of 5 year old boys.

Kindergarteners and mooning go hand in hand. Mooning and streaking are not sexual abuse by any stretch of the rational mind. Superintendent, you are to build children up not tear them down, now fix it.

Not everyone has the money to sue. This isn’t the kind of case a lawyer will take on contingency.

I think Kindergarten is one of the most wasteful uses of taxpayers money in education today. Much like Pre-K kindergarten a glorified taxpayer funded daycare service. Parents need to raise their own kids at home until age six. Our nation gives more serious thought to separating puppies and kittens from their mothers than children.

Where to start?..... No state juvenile or criminal code applies to any child under a specific age, usually 10, so there’s no basis for any disciplinary action against the kid. Any school policy that denies due process (parent, guardian or advocate attend) is illegal. Sounds like lawyer time to me!
