Drakes Bay oyster farm denied Supreme Court hearing

Oyster farmer Kevin Lunny's reaction to what looked to others like the last legal gasp of his operation at Point Reyes National Seashore punched right to the point: "It's not over until the last oyster is shucked."

"This is a disappointing decision, but it's not really a setback," Lunny said of the U.S. Supreme Court's refusal Monday to hear an appeal of a federal order that would shut down his Drakes Bay Oyster Co. "This ruling only gives us the strength and incentive to fight harder. This is not just about oyster farmers - this issue affects farmers and ranchers on federal lands throughout the nation."

More gov BS. How the hell is oyster raising a problem now. I wonder when they will try to close those dairy farms up in Inverness area given most have been in operation since before the war between the states.

That family has been there longer than any of the carpetbagging NE politicos in the state who claim ‘Green’ while they pollute the airwaves with their bogus science crap.

It’s a harbor seal breeding area is the claim. The family has had a dairy farm on that neck of the woods for years. They only recently took on the oyster farm assuming they could at least get a 10 year extension.. but now.. Salazar screwed them blue and them some. Even DiChiFi has tried to blow thru blockades of regs.. but..

sometimes its easier to shuck an oyster than a politician’s or greenie’s mind.

Feinstein steered a bill through Congress in 2009 that authorized the Interior Department to extend the lease for 10 years. But then-Interior Secretary Ken Salazar denied a renewal of the lease in November 2012, saying the oyster harvesting didn't fit Congress' plan for a wilderness area.

Seems to me that Salazar came to exactly the OPPOSITE conclusion that Congress authorized in 2009. But then, that's what happens when you put liberals in charge of anything.

Simple solution, if any of the hacks care to pull their head out and realize they are not royalty, but public servants...
Find a piece of “off-shore land” that they will trade to Drake’s for them gracefully vacating.

Drakes stays in business, they get their blessed “wilderness”, and it doesn’t happen again in 10 years or 40 years...unless of course, and this is very likely, the hacks decide they will just take the “off-shore land” away from them.

Other than the federal entities indicated in the Constitution’s Clause 17 of Section 8 of Article I, or land controlled under the eminent domain aspect of the 5th Amendment, the states have never delegated to the feds, expressly via the Constitution, the specific power to have exclusive legislative control over “offshore land” as freeper Izzy Dunne had questoned.

So what am I overlooking?

Patriots and former Obama supporters need to exercise their voting muscle in the 2014 eletions to win 2/3 conservative majority control of the Senate so that Congress can impeach lazy justices off of the bench.

I wonder how many $’s the competitors to Drakes Bay Oster Farm have contributed to the rats and the green eco terrorists.

This goes back to my old Cui Bono training, who benefits from an action like this?

Competitors will and those getting money from competitors.

The enviro Eco Terrorists and PETA people have had the dairy farmers in their cross hairs for decades.

The producers of so called artificial milk will be donating money to the Green Eco Terrorists and the PETA clowns to close down the evil dairies.

Good science should have played a key role in the Drakes Bay debacle, and open community discussion should have as well. But we didn’t get good science. Instead, the National Park Service, the Department of the Interior (DoI), and some local environmental supporters (with whom I often have strong common cause) manipulated, misreported and misrepresented science in their desire to support expanded wilderness.

I guess liberals would rather pay extra for NE oysters than support your local farmers and ranchers.

It all about CONTROL...ultimate control...ABSOLUTE CONTROL.

Neither Drakes Bay nor the Oysters nore the method of harvest have changed in the hundred years the farms been there!

ONLY the seething lust for absolute control has vastly enlarged itself.

spmeone MAY want the surrounding LAND....for OTHER commercial purposes....just like that chunk of ranch land in NEVADA
