Yankees fan caught sleeping on TV sues ESPN, MLB for $10 million

A New York man who was caught sleeping at a recent Yankees game against the Red Sox on ESPN is filing a $10 million defamation suit against broadcasters Dan Shulman and John Kruk for their "avalanche of disparaging words," according to the New York Post.

Andrew Robert Rector admitted that he "briefly slept" while in attending the April 13 game between the A.L. East rivals, and when ESPN cameras caught him sleeping during the fourth inning, the Sunday Night Baseball announcers launched into what he described as an "unending verbal crusade" against him, with their "vituperative utterances" redistributed on the MLB website the following day.

A YouTube video uploaded by MLB is titled "Fan sleeps in stands during game vs. Red Sox."

According to the report, Rector's suit was riddled with typos and improper grammar, claiming the broadcasters insinuated that he "is a fatty cow that need two seats at a time" and "is a confused individual that neither understands nor knows anything about history or the meaning of rivalry between Red Sox and Yankees."

ESPN, MLB and the Yankees are named as defendants in the suit.

Video and copy of formal complaint filed in Bronx Supreme Court (conveniently located a few blocks from Yankee Stadium on the other side of the #4 el ) at link. Amazing how he slept through all the cheering and hoopla earlier in the game when Beltran blasted yet another homer. But seriously, there is no expectation of privacy in a public venue, in a saner world this case would be laughed out of court.

This guy must have a $100k suit. The announcer ragged on him on-air for several minutes. “You’re on the wrong workout program buddy.” Of course, he couldn’t hear it.

As someone that has fallen asleep at a Yankees game, I believe he should sue MLB for putting on such a crap show.

Shulman and Kruk are the kind of broadcasters Baseball needs to keep the game interesting and vital.

Nothing worse than BORING telecasts.

but seriously, if we had mature, thinking adult men reporting games we'd have less personal attacks on fans, who are just a cheap target for the millionaire reporters....

can't imagine Phil Rizzuto having to attack the fans in order to report clearly on a game....

the sports entertainment complex has gotten just a little too much "entertainment" and not enough of sport...

Reminds me of the time in 1985, when People’s Airline had $29 fares to Boston. Six friends and I decided to fly to Boston to catch a Red Sox game. We’d been out partying the night before, and in about the sixth inning I woke up and looked at my buddies. They were all asleep! Must have been a great shot on the Jumbotron to see seven guys in their twenties all in a row sleeping. Wish I had a picture of it.

That guy needs to get a sense of humor.
