State Active Duty (SAD)
The Governor can activate National Guard personnel to “State Active Duty” in response to natural or man made
disasters or Homeland Defense missions. SAD is based on State statue and policy as well as State funds.
Soldiers and Airmen remain under the command and control of the Governor. A key aspect of this duty status is that the Posse Comitatus Act does not apply, giving National Guardsmen the ability to act in a law enforcement capacity within their home state or adjacent state if granted by that state’s Governor.
I would think Homeland Defense covers his ability and also for law enforcement within their home state.
Title 32 Full Time National Guard Duty can be called upon by the Governor with the approval of the POTUS.

A state’s authority does not trump federal authority especially in this instance.
It would be worth it to force Obama to use US soldiers, soldiers who sworn an oath to protect the Constitution and the US, to protect illegal aliens as they illegally cross our border from Americans who only want to law obeyed.

Secondly, the Feds do not have the power to take over a local school. This is a State vs. Fed issue and Perry is beyond weak, but typical of Texas governors.

Actually they told him they would arrest him if he didn't step aside, and the coward did. I watched it live on my 17 inch black and white TV.
The Governors will do nothing to reclaim their 19th amendment power, so I have no respect for any of the cowardly republicans.
Some here should remember how we were told by Perry, we had no heart if we didn't want to pay for illegals education.

As for the details of what Perry can do.
Use the Nat Guard to enforce the border. Yeah, you send the kids back. There are millions of kids just like this all over the world, these kids are no different.
Do what .gov is doing and transport the illegals to DC, and drop them off. That will get some attention.
Drop any State help to the Feds in the form of shelters, schools, and other resources until more enforcement is brought forth.

I was reading that the Governor does have the right to order the National Guard to protect the Borders. However, the President can then “Federalize” those troops and order them back off the border. Once the troops are Federalized, they have to obey the President’s orders.
I can see Obama trumping any Governor’s call up of National Guard to the border.
All the more reason for governors who actually care about Americans to call out the Guard!

It doesn’t change what a governor of any state has the authority to do. The name of the governor does not matter. The same thing could be said about Brewer, Martinez or Brown.
