Gary Harrington, the Oregon man convicted of collecting rainwater and snow runoff on his rural property, went to jail today.

They declared his property a wetland, so removing rainwater is “endangering” it. It doesn’t matter that the fire department relies on his supply of water as an emergency backup.

He is not an innocent, or a victim.

Water rights and the laws involving them are complex, but they have existed for centuries for a reason.

In the Founders' day, a farmer who dammed up a creek to prevent his neighbors herds or crops from being watered would be in a heap of legal trouble.

I used to collect the snowmelt to use for watering my carnivorous plant terrarium for my kids many years ago.

Better lock me up.

That is not the case.

This is not about environmentalism, but about water rights - specifically about Harrington diverting water from the Big Butte River.

I have thought of building a “stealth water reclamation system into my gutters to siphon it into the backyard into a giant tank for use for watering my lawn.

Just the water off my roof mind you.

That was the exact opposite situation.

That was the federal government arbitrarily preventing farmers from continuing to enjoy the benefits of local water flow on environmentalist grounds.

This is a private individual stealing 13 million gallons of water from his neighbors, and the state government won't let him get away with it.
