Republicans to sue Obama over health law

House Republicans are going forward with plans to sue President Barack Obama and will base their legal case on the sweeping health care law he championed and they despise.

Speaker John Boehner said the suit will follow the argument Obama violated the Constitution by circumventing Congress and changing the law's employer mandate on his own.

"In 2013, the President changed the health care law without a vote of Congress, effectively creating his own law by literally waiving the employer mandate and the penalties for failing to comply with it," Boehner said in a statement.

Why only the Republicans? When are AMERICANS going to have the “standing” to sue the bass turd?! What the hell does someone have to do to have “standing” in the clown courts?

It would be a lot more simple if Boner would simply say “Any law that Obama has changed is not a valid law. It does not have to be followed.”

Anyone that thinks the republican party is going to save the country is sadly mistaken. Mississippi proved just how corrupt the GOP turd pile is. They love the chamber of Commerce, not the American people.

Regardless that Boehner has twice witnessed the HoR read the Constitution at the beginnings of new legislative sessions, he is still ignoring that the states have never delegated to Congress, expressly via the Constituiton, the specific power to regulate, tax and spend for intrastate public healthcare purposes.

All Presidents have the power to commit treason, impeachable offenses. The House has the power to impeach a President for such acts.

The Senate has the power to confirm an impeachment. Asking the Courts to render judgement on an issue the House and Senate have full power to handle is inappropriate and, dangerous. Boehner is abdicating his responsibility to ACT APPROPRIATELY, something he accuses the President of doing.

Boehner may be accomplishing more. If in Nov. the House is reatained by Republicans and the Senate is gained, the Republicans would be under great pressure to impeach. If a mere lawsuit is in progress, the Republicans will not initiate impeachment proceedings for sure.

That is the point. The Republicans do not want to impeach the President under any circumstances even if they have the full power to do so.

Another consideration along parallel lines. Obamacare put all medical care under Executive Branch Control...that is the offense of Obamacare aside from incompetent formation and administration. The Republican establishment may offer to repeal Obamacare and replace it with another plan fully within the Executive Branch of government. The Republicans do not believe in private practice medicine and individual control of healthcare at all. As the Democrats, the Republican party wants full health management within the Executive Branch of govt. just as Democrats with a Republican “flavor” instead of a “Democrat” flavor.

So,a court suit against Obama may just result in a court decision that Obama had the power to commit treason, inappropriate acts and that the Congress has the right to impeach him. In the meanwhile the possiblity of impeachment will have probably been ....wasted, precluded by an inappropriate action by the Republicans in the House.

So, with Obamacare, healthmanagement will remain in the Executive Branch of govt if the Republicans win the Senate and hold the House in Nov., and any changes will have to survive a Presidential veto.

It is improbable that the Rep Party, as constructed currently, will significantly alter Obamacare or follow through with an impeachment of Obama.

Exactly!
So the President can file a counter suit against Mr. Boehner and the HoR/
And the Senate will sue the hell out of the Supreme Court?
I think this lawsuit against Mr. Obama will be bounced out very quickly, irrespective of the background of whatever Federal Judge hears it.

We can only hope that the judge who draws the case is a curmudgeon who tosses it out with a few choice words as well. I guess it’s too much to hope that the judge will call congress out as a bunch of sniveling cowards and quislings.

It makes me wonder what Obama has on Boehner. Extortion is pretty much a one way street with the old media an extention of the Democrat part.

John Boehner became Speaker of the House on January 3, 2011. If he and the Republican majority in the House were serious about ending Obamacare they’ve had the power to defund it since then by not including it in the annual appropriations bill. The fact the program is funded says they are complicit. Why go to the trouble of a lawsuit when you’ve had the power to end the program for 3 years?

There was no budget because the Republican House agreed to go along with Harry Reid’s “continuing resolution” funding scheme. The House did pass a budget and Harry Reid refused to bring it up in the Senate, insisting on continuing resolutions to fund the government. Boehner and the House Republicans could have said no, we are going by the Constitution. Instead they caved. When one caves, one acquiesces which essentially means one approves. The House had the upper hand and they failed. It was a conscious choice. Fear of the press is no excuse for doing the wrong thing.
