California couple conserving water amid drought could face fine for brown lawn

(Reuters) - A Southern California couple who scaled back watering their lawn amid the state's drought received a warning from the suburb where they live that they might be fined for creating an eyesore - despite emergency statewide orders to conserve.

Michael Korte and Laura Whitney, who live near Los Angeles in Glendora, said on Thursday they received a letter from the city warning they had 60 days to green up their partially brown lawn or pay a fine ranging from $100 to $500.

"I don't think it's right for us to start pouring water into our lawn in the middle of July during a drought," said Whitney. "We're kind of in a quandary about what to do."

The letter, bearing the official symbols of Glendora and its police department, came the same week that statewide water regulators passed emergency drought restrictions for outdoor water use. Those regulations, to take effect this August, require cities to demand cutbacks in water use, and empower them to fine residents up to $500 for overwatering their lawns.

In Soviet USA you get fined for using too much water and fined for having brown lawn, next year you move to apartment... Where you get fined to flying american flag... Then you move to Van down by the river and get fined for parking on a wet land... Pretty soon you get fined for living in carboard box that is not made out of recycled carboard...

A quote from "Atlas Shrugged" seems appropriate here:

“Did you really think we want those laws observed?" said Dr. Ferris. "We want them to be broken. You'd better get it straight that it's not a bunch of boy scouts you're up against... We're after power and we mean it... There's no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren't enough criminals one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What's there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced or objectively interpreted – and you create a nation of law-breakers – and then you cash in on guilt. Now that's the system, Mr. Reardon, that's the game, and once you understand it, you'll be much easier to deal with.”

Oh they did the same thing to us in Basic Training. One Sergeant would tell us to do something and then another would tell us to do the opposite. The first would come back and punish us for not doing what he told us to do. We eventually came out of it as trained killers, so no worry.

State statutes supersede local statutes unless the state statutes specifically say otherwise.

Station a couple of code enforcement types down the street. As soon as he goes to water the lawn, hit him with another water fine. Then increase his water rates...

The letter was also on Police letterhead. This is a slippery slope when cops with guns are involved in such trivial matters.

I owned a condo in San Diego from 1978 to 1983. The homeowner's association was already making plans for low water landscaping at that point in time. Some years later, the Mormon temple landscaping was redesigned to eliminate the nice fountains on the property...again, to get ahead of the expected water problems. An article published today cites 80% of CA as being in an extreme drought. My landlord is feverishly remodeling and preparing to sell the place where I rent a room. When that occurs, I'll return to Idaho. My landlord is planning to purchase in Idaho as well. The water problems are going to get worse.
